As usual no good deed goes unpunished and the saga continues. The most recent discussion concerning the fences in this area is that more than likely the plat for Windsor Estates will be refiled and the ability to encroach 10 feet into the Deforest Road right-of- way will disappear for the property owners on Brentwood Dr. However, the property owner at 928 Brentwood Dr. only wishes to move his fence back to his rear property line. When houses were originally build on Brentwood Dr., there was a borrow ditch with a gabion retaining wall built to convey drainage. With the development of Windsor Estates, the borrow ditch was filled in and a pipe was installed. Therefore, because the ditch was filled in, the ground is now level and the property owner at 928 Brentwood Dr. has the opportunity to move his fence to his rear property line, which is approximately 5 feet from the existing fence location. I have attached a survey plat of his property, which shows the existing fence being approximately 5 feet from the rear property line. The Engineering Dept. has no objections to the property owner at 928 Brentwood Dr. installing his fence along his rear property line, which is approximately 5 feet north of his existing fence.
