Villages of C P3-CS031222Sent to attached list COFFELL December 22, 2003 Re: Abandonment Request for a portion of Deforest Road Villages of Coppell Phase IIIB Lots 30 thru 35, Block A/920 thru 944 Brentwood Drive Dear Mr. & Mrs. Campbell: This letter is written as a follow-up to my September 4, 2003 letter concerning construction of fences in a portion of the Deforest Road right-of-way adjacent to the rear of your property. Since my letter in September, there have been several meetings with the developer of Windsor Estates, concerning the fact that an incorrect plat was filed in 2001 which created some discrepancies in the utilization of the 10-foot right-of-way adjacent to your property. The developer of Windsor Estates has submitted a new plat to the City of Coppell for approval. In reviewing the information associated with the new plat, it was the City's opinion that both parties could co-exist in the right-of-way. A portion of the Deforest Road right-of-way adjacent to 916 and 920 Brentwood Drive is necessary for the entry feature into the Windsor Estates subdivision. However, the right-of-way adjacent to the lots located at 924 thru 944 Brentwood Drive appears to be clear of the entry features for Windsor Estates. Therefore, staff comments on the plat was that the 10-foot tight-of-way adjacent to Lots 924 thru 944 Brentwood Drive could remain with the City of Coppell as right-of-way and that the license agreements entered into in July 2003 could remain in effect. On December 18, 2003, the Planning and Zoning Commission approved the replat of Windsor Estates with those comments. That replat is scheduled to go to City Council for approval on January 13, 2004. If Council approves the replat on January 13, 2004, with staff comments, then the issues concerning the 10-foot right-of-way will be resolved. With Council approval, the final resolution will be that the properties at 924 thru 944 Brentwood Drive will maintain the ability to utilize the 1 O-foot excess right-of-way of Deforest Road as noted in the July 2003 license agreements If Council approves the replat, I will forward a memo to building inspections informing them that I no longer have a hold on any fence permits. I know that this has been a long process, but the fact that an incorrect plat was filed in 2001 really complicated this issue.
