SCOPE:= OF:SERVICES Based, on. our ~ discussions and review of the information received to date, the following is: our!: perception of the services to be provided by Pacheco Koch for the referenced project: Included in this item' are the following: Obtain additional topography as required to supplement topographic information provided by the city; 2. Prepare paving plans for the roadway; Prepare plans for water and sanitary sewer, drainage, street lighting and irrigation conduit associated with the roadway and as required to serve the proposed Police and Fire Station facilities; Modify standard City bid documents and technical specifications to meet specific site requirements; 5. Prepare "As Built" plans using mark-ups provided by the City. 6. Glenn Cramer April 11, 1995 Page Two The following items are not included in this proposal: 1. Landscaping and irrigation; 2. Solicitation of bids and recommendation of award; 3. Review of shop drawings and pay requests; 4. Construction observation or inspection; 5. Construction staking; 6. Geotechnical engineering; 7. Materials testing. Pacheco Koch acknowledges the importance to Phillips Swager Associates, of the project schedule and agrees to put forth its best professional efforts to perform its services under this Agreement in a manner consistent with that schedule. Phiflips $wager Associates understands, however, that Pacheco Koch's performance must be governed by sound professional practices. If requested, Pacheco Koch would be pleased to develop a project schedule outlining each of the items in the scope of services. COMPENSATION Pacheco Koch proposes to provide the services described above on a Fixed Fee basis of $ 28,000.00. A statement for services performed by Pacheco Koch shall be issued on a monthly basis, based on an estimated percentage of completion of each item in the scope of services and shall be payable upon receipt. In the event the project is suspended by the owner for more than 30 days, Pacheco Koch shall be reimbursed for services compleled to date, based upon estimated percentage of completion of the services to be provided by Pacheco Koch. Phillips Swager Associates, through its authorized representative identified below, and Pacheco Koch Consulting Engineers, Inc., have discussed their risks, rewards and benefits of the project and Pacheco Koch's total fee for services. Neither Pacheco Koch Consulting Engineers, Inc., nor their consultants, agents, or employees, shall be jointly, severally or individually liable to Phillips Swager Associates in excess of the compensation to be paid pursuant to this agreement or of one hundred thousand dollars ($100,000.00), whichever is greater, by any act of omission, including breach of contract or negligence not amounting to a willful or intentional wrong. l~h'. Glenn Cramer April 11, 1995 Three SUMMARY This proposal, unless otherwise noted, constitutes our understanding of the services to be provided by Pacheco Koch Consulting Engineers, Inc. on the project described above. Additional work outside the scope of that presently defined, with the exception of work covered by subsequent specific written proposals, will be charged on an Hourly Rate basis. Any significant modification from the present Scope of Services must be approved in writing by the client.
