St Andrews Est-CS040129 (2) MEMORANDUM FROM THE DEPARTMENT OF ENGINEERING To: From: Date: Chief Kruse, Fire Department Greg Jones, Building Official Perri Kitties, Environmental Health Officer Glenn Hollowell, Assistant Director of Public Works Gary .Sieb, Director of Planning L~is, Construction Inspector Jan~y 29, 2004 St. Andrews Estates From the physical activity observed on the above-mentioned project (the former Service Center site) it appears that the owner/operator, Holmes Builders, has been issued a demolition permit for this site. Field observation made on January 27th at 1:30 p.m. shows the owner/operator to be outside of many of the regulations set forth by City of Coppell ordinances, the State of Texas and the federal government. A short meeting was held on January 28th with a representative from Holmes Builders to discuss some of the issues relative to the site. The purpose of this memo is to provide information related to the limits of a demolition permit. The activity apparently encompasses removal of all paved areas around the existing structures including the driveway leading to Deforest Road. It is my concern that during the removal process, Holmes Builders has made no provision to protect the quality and soundness of services in the right-of-way and easements that belong to the City of Coppell (water, sewer and emergency access). There is also a concem that proper drainage has been altered. In addition to the concern of maintaining the soundness of services is the concern that utilities - water, sanitary sewer, electric power, underground gas lines and oil/grease traps - appear to be in service and have not been properly disconnected or removed while the work activity is taking place. Various individuals are working in, around and over these utilities which presents a safety concern, as well as concern that there is no protection from ingress/egress to this site for the general public. The representative from Holmes Builders was requested to make immediate temporary corrections to alleviate some of these concerns. He was also encouraged to contact various City divisions for assistance in these efforts. It is my understanding that the owner/operator has followed through with plat requirements although, as of this date, the plat has not been filed. The Engineering Department has not, as of this date, approved any construction plans or permitted any construction activity at this location. We respectfully request that you provide any assistance needed to the owner/operator in the proper methods to achieve compliance in all areas. We would like to make you aware of the adopted ordinances related to approved development activity in the City of Coppell. Under the Code of Ordinances of the City of Coppell, some of these requirements are based on federal and state laws regarding development in floodplain areas of which the above is adjacent to and a portion off Hereafter listed are some of the most important requirements for development on this tract: I. TCEQ - the contractor will be required to develop and implement a site specific Storm Water Pollution Prevention Plan (SWP3) in accordance with the conditions of the Texas Pollution Discharge Elimination System General Construction Permit (TXR 150000) prior to construction, and submit a Notice of Intent to the MS4 (City of Coppell) 2. FEMA - a flood study must be submitted and accepted with all applicable fees paid and all data necessary for conduct of the review included. The City of Coppell will issue a Floodplain Development Permit after acceptance of the submitted data by FEMA and subsequent issuance of a Conditional Letter of Map Revision. If a Letter of Map Amendment is obtained, then a permit will be issued after receipt of the LOMA by the City. 3. Erosion aad Sedimentation Control Code - Ordinance No. 91514 was designed to minimize erosion and sedimentation from private property onto public rights-of-way, making it unlawful to permit a public erosion nuisance and providing, for a penalty of fine not to exceed the sum of $500 per day during which a violation occurs. 4. Tree Preservation Ordinance No. 91500-A-203 - regulates the removal and replanting of trees during development, requires a Tree l~.emoval Permit when removal is necessary, and authorizes a City representative to place a Stop Work Order on any activity in violation of Section 34-2 We respectfully request that you immediately contact your client, Holmes Bui~.ders and make them aware of the federal, state and local requirements that must be adhered to prior to a~y work activity of any kind taking place in the subject location. Please contact this office so that we can discuss with you your clients' compliance to all applicable laws and ramifications of failure to adhere to those laws.
