Re: Interlocal Agreement for Sandy Lake Road
Dear Mr. Griffin:
We have reviewed the draft of the ILAfor the Sandy Lake project
as provided by your office on October 15, 1997, a copy of which
is attached.
We are submitting the following revisions for your
consideration:
For Section II, we propose the following wordings:
"Dallas agrees to provide all funding for the cost of the City
requested items. Subsequent to Coppell receipt of construction
contract bids and prior to the award of such contract, Coppell
shall notify Dallas of the total cost of construction of Dallas
funded items as determined by the unit bid prices for the Dallas
funded quantity of work cost. Dallas shall encumber such amount,
establish an escrow account and shall deposit funds equal to the
total cost of construction in said account prior to the award of
construction contract. Coppell will bill Dallas on a monthly
basis based upon actual Dallas funded work performed during the
the month. Dallas agrees to pay such billing within thirty (30)
days of receipt of monthly billing. Upon completion of the
project, Coppell will do a final accounting of the cost of
Dallas funded items. In the event that the amount paid by Dallas
exceeds the actual cost, the difference will be remitted to
Dallas. In the event that additional funds are due, Coppell will
bill Dallas who agrees to pay such funds within thirty (30) days
of receipt of such billing.
For Section IV, replace the word "control" with "assurance", as
indicated on the attached copy of the draft.
For Section VI, insert the phrase "design of the project and",
as indicated on the attached draft.

For Section VIII, replace the title "Construction Engineer" with
,,Project Manager", as indicated on the draft.
For Section X, insert the phrase "and construction change
orders"; and add the sentence ,'Fundings for all change orders
shall be in accordance with Section VII through IX.".
For Section XI, revise the signatory block as shown.
Please send us a revised draft as soon as possible for our
attorney's review.

Coppell, Texas, hereinafter called "CoppeU", wish to enter into nn Agreement for the
construction/relotmfion of DaHas's 30" water main and adjustment of Dallas, 's existing water
appurtenances located W~_'thin the City. limits of the City of Coppert along and paralld to
Sandy Lake Road between Denton Tap Road and MacArthur Boulevard; and
WHEREAS, the Interlocal Cooperation Act, Chapter 791 of the Texas Government
Code, provides authorl-m~on for any local gOVernmelit to contract with one or more local
governments to perform govcrnmontal functions and services under the terms of tumid Act;
NOW THEREFORE, this Agreement is hereby made and entered into by .the Cities
of Dallas and Coppea for the m.n. tllaJ eon.~ideration stated herein:
Dallas hereby requests Coppen to ~onstruct pursuant to the te,-~s of this Agreement
Dallas's new water facilities located along and parallel to Sandy Lake Road between Denton
Tap Road and MacA~ur Boulevard. Coppell droll also, in connection with such facilities,
relocate or adjust its own water and wastewater appurtenances, and provide sidewalks,

Dallas hereby agrees to be responsible for approval of all design changes and to
provide for any additional funding necessitated thereby, or for any increase in the quantity
of Da!las's construelion.
