County: Dallas, Denton City Project # ST 95-01 Dear Mr. Shirley: This letter is written as a follow-up to our previous conversations concerning drainage associated with the referenced project. During those conversations, we discussed the fact that if the water could be taken to the east and discharged into the existing 10'xl0' box culvert constructed by Vista Properties that there would be a cost to the City and the adjacent property owners. There would also be a savings to the State in both the construction cost of the system and the time involved in the acquisition of easements. During those conversations, I explored the possibility of the State funding the $10,000 to buy capacity into the existing 10'xl0' box culvert. Conversation at that time was that the State would not be willing to fund the dollars, however, they would be willing to consider some "in kind" offsets associated with construction of the S.H. 121 Bypass. Our conversations generally revolved around amenities such as brick pavers at the intersection of the proposed Bypass with Denton Tap Road. Attached with this letter, I have provided a drawing of plan/profde sheet 8a showing general locations of proposed brick pavers and a 6' foot sidewalk associated with S.H. 121. The brick pavers represent a 15' band of pavers as shown in the City's Streetscape Plan for secondary intersections. The reason I am using the secondary as opposed to major is that a major requires a full paved stone intersection. In this case, the City would only be seeking the banded pavestone intersection. I have enclosed a copy of the portion of the Streetscape Plan that references the secondary intersections. Also shown on the attached sheet is a proposed 6' sidewalk located away from the thru lanes, however, adjacent to the turnaround lanes. Because S.H. 121 intersects Denton Tap on a skew, the brick pavers are shown on a skew. The City would not be opposed to the brick pavers being constructed at a 90 degree angle to Denton Tap Road. However, that could create some additional handicap ramps required for the corners. Also, on the northern edge it appears as though the brick pavers could clip the proposed median, therefore, you may want to consider moving that nose further north. The location of the handicap ramps also may need to be adjusted. The City looks forward to hearing from you in the near future concerning the ability of the State to fund the minor amenities requested for this intersection as part of the total construction package for the S.H. 121 Bypass. In regards to the drainage issue, we have received approval from City Council to enter into an agreement with Vista Properties and Coppell 200 Joint Venture and have received authorization to fund the initial $10,000 to buy capacity into the system. I am currently in negotiations with the attorney for Vista Properties concerning the agreement that will allow the City to pay the $10,000 and for Vista Properties to receive offsetting credits against future roadway impact fees. There has also been conversation with the Engineer for the Coppell 200 Joint Venture in regard to a future pro rata agreement for the City to recoup some of the offsets that will be afforded Vista Properties. Vista Properties also has stated that as part of the agreement they will provide an easement to the City that encompasses the 10'xl0' box culvert. This project is moving forward and I appreciate the willingness of TxDOT and yourself to allow the City to resolve the drainage issues as the end result has provided a cost savings to all parties involved. Through a separate agreement, Mr. Rider Scott of the firm David A. Dean and Associates has agreed to work under the direction of this office in the right-of-way acquisition for the project. Mr. Scott' s assistance is appreciated and is being provided at no cost to the state of Texas. While the Transportation Division of this office will make final decisions relating to .the legal matters, Mr. Scott and his firm will be required to protect and exercise the same attorney-client privilege with information provided them, as if it was provided to an employee of this office. The formal creation of our relationship with Mr. Scott has been accomplished by separate letter agreement as well as verification of "no conflicts of representation". I know this project is important to the residents and businesses of south Denton and Collin and north Tarrant and Dallas Counties. I appreciate your taking the time to highlight the project's history and its importance to your area. I am hopeful this arrangement will allow the state to move as expeditiously as possible in securing the right-of-way necessary for this phase of the project. Thank you for your interest.
