Denton Tap Road, Suite 150 Coppell, Texas 75019 Dear Mr. Van Ness: I have received and read your May 22, 1989 letter concerning access to Denton Tap Road from Northlake Woodlands and Denton Tap Medical Plaza. After consulting with the Project Engineer, Ginn, Inc. and observing the site personally, I have given the issues raised by your letter careful consideration. At this time there is adequate temporary access from Northlake Woodlands and the Medical Plaza to provide for normal business and emergency vehicle traffic. It is a very inconvenient situation, and I can well understand and sympathize with your frustration over the situation. We were initially told by the Contractor that the intersection would only be closed for about four days while the earthwork and storm drainage were being installed and then a two way asphalt surface would be constructed from Meadowcreek out to the completed west side of Denton Tap Road. In looking into this, it has come to my attention that weather played a part in delaying the completion of this portion of the project in the time allotted by the Contractor's construction schedule. As a result of delays on the part of the weather and the Contractor's need to utilize his resources to his best advantage in completion of the work of the entire project as a whole, the Contractor has made a conscious decision to postpone the completion of the Denton Tap Road/Meadowcreek Drive intersection. The Contract between the City of Coppell and the Contractor, L. H. Lacy Co., allows him to perform his work by his own means and methods and does not allow the City to dictate his sequencing and scheduling of construction activities in the accomplishment of the project as a whole. I would like to point out that our Project Engineer, Ginn, Inc., is not responsible for the Contractor's sequence and schedule of work. Our Project Engineer has the responsibility for assuring general conformance of the Contractor's work with the Contract Specifications and Drawings, and verifying quantities of completed or partially completed work for payment as well as representing the City of Coppell in addressing the concerns of the adjacent property owners and businesses. If the Project Engineer's project personnel have been discourteous, or untruthful to you in the performance of their duties associated with the project, please provide me with specific information regarding the individuals name, date, time, location and subject matter in question and I will pursue it. I don't believe anyone associated with the project on the City's or the Engineer's staff has made any promises on behalf of the Contractor. In reciting the above, Mr. Van Ness, I am not taking issue with your concerns and frustrations, or trying to protect myself or the Engineer. What I am doing, however, is trying to show the other side of the fence, and give you the overview of the difficulties with which we must contend in order to bring about these Capital Improvements Projects for your benefit as well as the rest of the community's benefit. I assure you that if any health or safety problems are identified in association with the current Meadowcreek situation, we will not hesitate to have them rectified immediately. I apologize for the inconvenience with which you must contend at this time, and ask you to please be patient for a little longer while we explore the options with the Contractor. Sincerely, Alan D.
