Dear Mr. Saunders:
Recently while negotiating right-of-way, it came to the City's attention that the owner as shown
on Parcel #17 is not the owner of the property. This is not a recent transfer as the owner of the
property is the original owner of the property from the 1980's (Sandy Lake Comers JV, the
same owner of the property on Parcel #20). Parcel #17 is situated at the northwest comer of
Sandy Lake with Moore Road.
Your construction plans show that there is an existing 25 foot right-of-way across the front of
that property. That 25 foot has never been dedicated. The property was preliminary platted as
Sandy Lake Plaza but the only portion that was actually final platted was at the very north end
as Children's First Academy. Therefore, not only does Parcel #17 need to be revised to show
the correct ownership, but the permanent right-of-way also needs to be revised to account for
the fact that the 25 feet still needs to be acquired. We are in negotiations with this property
owner and he has requested that we provide him with the actual taking as soon as possible so
that we can consummate the negotiations. Please have the surveyor revise this document and
provide it to the City as soon as possible.

Dear Mr. Saunders:
Recently while negotiating right-of-way, it came to my attention that right-of-way Parcel #29
was provided to the City incorrectly. Right-of-way Parcel #29 shows Joann Benson as the
owner of the tract of the land between Sandy Oaks Addition and the Lutheran Church, with a
frontage of approximately 168.12 feet. In actuality, this is two tracts of land with a portion
being owned by Ms. Benson and a portion being owned by Lewis Padgett III.
I am including a copy of our tax roll maps that show Tract #11 as being a tract owned by Ms.
Benson and Tract #10 as being a tract owned by Mr. Padgett. This land has been on the tax
rolls in this configuration for sometime. Therefore, there should have been some record of it
when your surveyor was researching the property. Right-of-way Parcel #29 needs to be revised
with two separate parcels provided to the City, one for Ms. Benson and one for Mr. Padgett.
Ms. Benson is ready to sign the documents and is only waiting for correct information.
Therefore, the sooner we get the revised documents the better.
