defined) unto Grantee.
As used herein, the term ,,Property" means those certain tracts
of land situated in the City of Coppell, Dallas county, Texas, more
particularly described om Emhibit A attached hereto and
incorporat~ herein by reference for all purposeS, together with
all and singular the improvements thereon and all riqhts and
appu~enanoes thereto in anywise belonging, /noludl g, but not
limited to, any right, title or intereet of Grantors in or to any
str~p, or gores ~etween said tracts of land and abuttin~ realty and
any reeidu=ry rights of Grantors in or to any portion of said
tracts of land or abutting realty presently encumbered by
rights-of-way or easements.
This conveyance is'made and accepted subject to those
encu~orances (the ,,Permitted Encumbrances") described in EF~hibit B
attached hereto and incorporated herein by reference for all
purposes but only to the extent that the same are valid and
subsisting and affect the Property.
TO HAVE AND TO ~OLD the Property, subject to the permitted
forever; and Grantors do hereby bind themselves and their
successors and assigns to WAPd%qNT AND FOREVER DEFEND all and
singular the Property unto Grantee and Grantee's successors and
assigns against every party whomsoever lawfully claiming or to
claim the same or any part thereof, by, through or ~ndsr Grantors,
but not otherwise.
In tliat certain Special Warranty Deed, dated as of January 1,
1990, from The Parka of coppell Joint Venture ("PCJV") to Grantora,
recorded in Volume 90003, page 3433 of the Real Property Records
of Dallas County, Texas (the "Prior Deed"), PCJ~; agreed to pay:
(1) ail property taxes levied or assessed against the Property for
1989 and prior years; and (ii) all property taxes levied or
assessed against tbs Property after December 31, 1989 (including
all applicable penalties and interest), attributable to the
"recaptare" or "rollback" cf property taxes arising or resulting
from the utilization of "open land art" or ,,agricultural use"
property tax relief provisions ~uring periods of time prior to
January 1, 1990.
By acceptance hsr~of, Grantee hsr~y assumes the payment of
all property taxes levied or assessed against th~ Property for 1990
and subsequent years, except for the property tax®s to be paid by
PCJ~pursuant to the Prior Deed.
EXECUTED by Grantors on the date of each party's
acknowledgment but dated and effective for all purposes as of the
28th day of June, 1990.
