It is our opinion that this determination has been reached in error, possibly due to either insufficient of erroneous information. In consultation with the City Manager's Office (CMO), we have been directed to engage your office to develop an appeal to the TxDOT denial of the proposed portion of the SLRMUT application. Please review the attached material and let me know your recommendations indicating how we should proceed with this issue. As you can see from Page 2 of the letter transmitted by Mr. Edward Owens, Senior Planner of NCTCOG, there are only 15 days to respond to the TxDOT letter. Please contact my office so that we might be able to discuss your recommendations, concerns, and costs associated with your assistance. An appropriate response must be prepared prior to the June 14 deadline. Our response must be transmitted to Mr. Edward's office at NCTCOG, who will then transmit his recommendation to TxDOT. Box 478 Coppell, Texas 75019 Dear Mr. Sims: Please find enclosed a letter received from the Texas Department of Transportation CTxDOT) Austin office regarding the Sandy Lake Road Multi-Use Trail and Landscaping project submitted for the Statewide Transportation Enhancement Program (STEP). In. summary, the letter states that some activities proposed in your nomination are not eligible for funding under the Statewfde Transportation Enhancement Program (see enclosed letter for description of activities). Therefore, these items will be eliminated from the proposed project. The portions that are eligible will be considered if you elect to pursue the eligible activities proposed in the nomination. There are two ways to respond to TxDOT's letter. The first way is for the City or Sponsor to resubmit a revised budget to the Austin address listed on the letter, which reflects the elimination of fllese ineligible activities. As the North Central Texas Council of Governments (NCTCOG) contact person, please provide me with a copy of the letter indicating you have coordinated this effort through the. Metropolitan Planning Organization (MPO). The second option is the appeals process, if you feel this determination has been reached in error. If you wish to appeal the decision, NCTCOG, as the nominating entity, must file the appeals on your behalf. To assist our efforts, please provide us written justification as to why you consider the activities in question to be eligible under the project category. Keep in mind that each project must demonstrate a link to transportation, and go above and beyond standard transportation activities. Project screening was performed to ensure that each candidate project received the serious consideratiou it deserved. It has been determined that the portion of the trail along Sandy Lake Road directly affected by roadway construct/on should be built in conjunction with and at the same time Sandy Lake Road is widened, Consequently, this portion of the trail is eliminated from the proposed project.
