SUBJECT: Sandy ! zke Road Multi-Use Trail - ISTEA Grant Application
Dear Karl:
Please find attached correspondence received by our office from both the Texas Department of
Transportation (TxDOT) and the North Central Texas Council of Governments (NCTCOG),
regarding the City of Coppell's ISTEA grant application for funding of the Sandy Lake Road
Multi-Use Trail (SLRMUT). It is our opinion that this determination has been reached in error,
possibly due to either insufficient of erroneous information. In consultation with the City
Manager's Office (CMO), we have been directed to engage your office to develop an appeal to
the TxDOT denial of the proposed portion of the SLRMUT application. Please review the
attached material and let me know your recommendations indicating how we should proceed with
this issue. As you can see from Page 2 of the letter transmitted by Mr. Edward Owens, Senior
Planner of NCTCOG, there are only 15 days to respond to the TxDOT letter. Please contact my
office so that we might be able to discuss your recommendations, concerns, and costs associated
with your assistance.
An appropriate response must be prepared prior to the June 14 deadline. Our response must be
transmitted to Mr. Edward's office at NCTCOG, who will then transmit his recommendation
to TxDOT.

Dear Mr. Sims:
Please find enclosed a letter received from the Texas Department of Transportation CTxDOT)
Austin office regarding the Sandy Lake Road Multi-Use Trail and Landscaping project
submitted for the Statewide Transportation Enhancement Program (STEP). In. summary, the
letter states that some activities proposed in your nomination are not eligible for funding under
the Statewfde Transportation Enhancement Program (see enclosed letter for description of
activities). Therefore, these items will be eliminated from the proposed project. The portions
that are eligible will be considered if you elect to pursue the eligible activities proposed in the
nomination.
There are two ways to respond to TxDOT's letter. The first way is for the City or Sponsor to
resubmit a revised budget to the Austin address listed on the letter, which reflects the
elimination of fllese ineligible activities. As the North Central Texas Council of Governments
(NCTCOG) contact person, please provide me with a copy of the letter indicating you have
coordinated this effort through the. Metropolitan Planning Organization (MPO). The second
option is the appeals process, if you feel this determination has been reached in error. If you
wish to appeal the decision, NCTCOG, as the nominating entity, must file the appeals on your
behalf. To assist our efforts, please provide us written justification as to why you consider the
activities in question to be eligible under the project category. Keep in mind that each project
must demonstrate a link to transportation, and go above and beyond standard transportation
activities. It may be helpful to review your ~Linking Yesterday, Today and Tomorrow" Texas
Department of Transportation Enhancement Program Guide, Third Call for Projects. Staff is
available to assist you if needed.

Dear ,Mr. Owe=s:
Thank you for submitting the Sandy Lake Road Multi-Use Trail and Landscaping project for ~e
Statewide Transportation Enhancement Program. The Texas Departmeat of Transportation
(TxDOT) and the Federal Highway Adminisn'ation (H-IWA) staffhave screened each candidate
project to determine eligibility for the program. Project screening was performed to ensure that
each candidate project received the serious consideratiou it deserved.
After careful review, we have determined that some activities proposed in your uomiuation are
not eligible for funding under the enhancement program. It has been determined that the portion
of the trail along Sandy Lake Road directly affected by roadway construct/on should be built in
conjunction with and at the same time Sandy Lake Road is widened, Consequently, this portion
of the trail is eliminated from the proposed project. Please provide us with a revised budget
reflecting the elimination of the ineligible port/on of the roadway from the proposed project.
lfyou believe this determination has been reached in error, you have the opportunity to appeal
this decision. We must receive your written appeal within 15 days of receipt of this letter. Your
appeal should be directed to Mr, Wm, G. Burnett, P.E., Executive Director oft. he Texas
Department of Transportation. Please review the Rules for the Statewide Tranxportation
Enhancement Program if you are considering filing an appeal..

Although some of your project's proposed activities are not eligible for the Sta~&
Transportation Enhancement Program, portions of your project are eligible. You may elect to
pursue the elig/ble activities proposed in this nomination or withdraw your nomination for
c.~nsideratlon if you feel it c~-not be implemented without the ineligible activities. Please send a
written notice of your decision within 15 days of receipt of this letter. If we do not hear from
you, we will assume you wish to withdraw this nomination.
Partial eligibility status does not guarantee that the eligible portions of your projec! will be funded;
it means that el/g/bio portions of your project may be considered by the Texas Tm.n-_qpottafion

with ali other projects nominated when the final selections are made. We anticipate that the Texas
Transportation Commission will make its selections at its August 1996, meeting. As soon as the
