Declaration of Emergency
Expenditure to correct ADA issues associated with
Sandy Lake Road Project #ST 93-02 (Denton Tap Road to MacArthur Blvd.)
The Engineering Department has been working with the State of Texas, the design engineer, and the
contractor for the Sandy Lake Road project to resolve issues associated with the Texas Accessibility
Standards Act. Extensions of time and appeals have been exhausted for this project. The
Engineering Department was unsuccessful in getting the Texas Department of Licensing and
Regulations to reconsider some accessibility issues associated with the project interfacing with
existing development.
On March 19, 2004 a notice letter was provided to the City of Coppel! stating that all violations
associated with the Texas Accessibility Standards Act should be completed within 90-days from the
date of the letter. The Engineering Department has negotiated with the contractor on the project, Ed
Bell Construction Company, to resolve all ADA issues associated with the Sandy Lake Road Project
#ST 93-02. The Engineering Department has also been working with the design consultant,
Kimley-Hom and Associates, Inc., to participate in the cost of the project; and continues to wait on
a final response from Kimley-Hom, Inc.
The estimated total cost of the ADA corrections is $85,227. This only includes the items over and
above the numerous items being removed and replaced at no cost to the City by Ed Bell
Construction Company, which were constructed incorrectly.
The State of Texas' mandated timeline to have all items corrected is June 16, 2004. Because of that
timeline, I am declaring this expenditure an emergency under Section 1-5-6 G. of the Code of
Ordinances, which states if an expenditure exceeds $15,000, the city manager may in the event of an
emergency expenditure declare an emergency and have that declaration approved by the city
council.
