Review of the agreement between the City and CP-Coppell Industrial, Ltd., regarding impact fee credits for Bethel Road fight-of-way, indicates that further action must be completed by CP-Coppell Industrial, Ltd. by Fall 2002. An impact fee credit agreement was approved by Jim Witt m October 2000, which granted CP-Copp~I1 Industrial, Ltd. a $109,000 roadway impact fee credit, with the condition that CP-Coppell Industrial, Ltd. would plat the remaining balance of the site at Bethel Road by October 11, 2002 (two years from granting the credit). As indicated in the attached documents, the $109,000 credit was based on the entire 1.87 acres being dedicated as fight-of-way and only a portion (.86 of an acre) has been dedicated. Additionally, the two-year time limit was derived in conjunction with the City's schedule for Bethel Road improvements in this area. To address this condition, CP-Coppell Industrial, Ltd. may plat the remainder of the property as required, or transfer the remaining 1.01 acres of needed fight-of-way to the City. If the needed fight-of-way is not conveyed to the City, the $58,600 credit received for the portion of right-of-way that has not yet been platted shall be remitted to the City. Please inform us, as soon as possible, of your proposal to fulfill the conditions of the agreement. Champion has worked very closely with city staff to plan our proposed development of this site and we very much appreciate the assistance we have received from cveryone we have worked with at the city. We look forward to a successful project that will benefit all panics. As part of the work already performed to initiate this development, Champion has contributed approximately 1.87 acres of its land to the city for future right-of-way for tho expansion of Bethel Road. This land cost Champion a little more than $1.34 per square foot, or approximately $109,000. This figure represents cost and not the current value. In addition, Champion contributed $93,960 for the upgrade to construction of the improvements to Bethel Road that were made in the first quarter of this year by tho city. The combination of thc right of way dedication and the road improvement contribution totals $202,960 that Champion has readily committed to the City of Coppell. We are now in the process of submitting our approved finaI plat for recording and applying for a building permit for our first 600,000 square foot project. The Roadway Impact Fcc asscsscd by the city for this project amounts to $190,800. In accordance with our previous discussions, CP-Coppcll Industrial, Ltd. and Champion Partners, Ltd. hereby respectfully request that the City of Coppcll allow a credit of $190,800 be applied toward the payment of this specific Roadway Impact Fcc. We am requesting this credit due to the payments and contributions already made to the city for current and future improvements to Bethel Road. SMG:cc COFFELL October 11, 2000 Steve Golding Champion Partners 1560 Dallas Parkway, #100 Addison, Texas '/5001 RE: Imact Fee Credits Dear Mr. Oolding: After reviewing your request of October 2 with our City Engineer and legal staff, we will be in a position to credit you $109,000.00 regarding the contribution of approximately of 1.87 acres of land to the City for future right-of-way for the expansion of Bethel Road. While this entire area has not been platted, the City xi'ill go ahead and extend this credit to you at this time. At the present time, .86 acres have been dedicated with Lot 1, Block A of the Coppell Industrial Addifign. We will be ready to credit the balance of 1.01 acres at the same $1.34 a square foot, provided that you sign an agreement that states that your platting shall occur within two years from the date of this letter. We feel that this particular process will not only be beneficial to Champion, but also to the City by claiming this Impact Fee credit request at this time. With regard to the $93,960.00 request for the improvements made on Bethel Road, our present Ordinance does not allow for any credits to be provided. Since those additional costs were assumed by Champion so that they could utilize Bethel Road in the first stages of your development phase, costs are not eligible.
