It is still my opinion that you should contact them because it will be difficult to construct this project without accessing their property, but it will not be required. If during plan design or review or during construction one of the three mentioned items in paragraph one change, ie. velocity increases, then the City will require contact of the adjacent property owner. However, will the additional width of flow cause any problem downstream in regard to width of the channel at your east property line, ie., is the channel cross section on the adjacent property adequate to handle the additional width of the channel?
