RE: Reciprocal Shopping Center Easement Agreement
Dear Sir:
On November 12, 1987 McDonald's Corporation and H.T. Ardinger Jr. entered into a Reciprocal
Shopping Center Easement Agreement (Volume 87229, pg. 2137) for ingress/egress and utilities
along the southwest comer of Denton Tap and Sandy Lake. The ingress and egress easement
covered Parcels 2, 3A, and 3B. The Agreement covers maintenance of various parcels in regards
to the driving surface. It has come to the attention of the City of Coppell that several areas along
the ingress/egress easement have experienced surface deterioration that could cause damage to
vehicles traveling across the ingress/egress easement. The Reciprocal Shopping Center Easement
Agreement is a private agreement between two entities of which the City is not a party to.
For the benefit of our citizens, 1 am requesting that each party review the agreement to ascertain
whose responsibility it is to repair the ingress/egress easement so that it is in a safe and drivable
condition.
