RE: Intedocal Agreement

On behalf of J.D.B. Real Estate Investments, Inc., I am requesting that an item be placed on the
June 8~ City Counci[ Agenda to consider entering into an Interlocal Agreement with the City of
Lewisvil[e to allow the City of Lewisville to serve the property with water. This would only affect
the water system.
This request is primarily due to the following:
1. City of Lewisville water mains currently surround the property.
2. This Agreement will avoid the parallel City water mains to be maintained.
3. The project is considered one village. Two water systems complicate the internal
looping of water and also the fact that we intend to maintain all of the property with a
common management company.
4. The revenue generated from taxes will more than offset any minimal gain from water
consumption.
This development is unique in that it is located in two cities and two counties. Even with this
issue, the development will be a quality community that will be an asset to this area.

I've looked at the agreement and spoken with Kumar at Lewisville. I am copying Kumar on this email so he will have a copy of the
agreement. I have some concerns with Section V on who should indemnify who. My opinion is that Lewisville should indemnify Coppell
against anything that happens during the operation and maintenance of the system. Lewisville may have some concern over that. Kumar
has requested, and 1 agree, that no one City should take action until both Cities are ready to move forward.
At this time i will await comments from Lewisville before I take any additional action on this agreement.
