Dear Mr. Guzman:
According to the wording in the referenced Maintenance Bond that states, "...the Principal is
required to post a bond to protect the Obligee against the result of faulty material or workmanship
for a period o_f two Fears from the date of acceptance of saM work. and; further stated in the bond,
"Principal shall for a period of two years from and after the date of acceptance of said work,
replace anF and all defects arising in said work whether resulting in defective materials or
workmanship which may become apparent during the saM period... "your company is responsible
for repairing or replacing defects such as those found in the portion of Nash Street constructed
during the summer of 2002.
Because your company has been notified twice (by letters dated June 11, 2004 and July 15, 2004,
copies attached) that the pavement installed by your company has suffered failures in two locations
where the street was cut, we are, therefore, at this time attempting to exercise our rights under the
terms of the surety bond. If you would care to meet with me onsite, I am available. Please contact
