Comments: Ken, Attached is letter I received from TxDOT area office regarding increase of costs to the above project. I believe that you are aware of these items. We could keep costs down if your City is willing to provide the detour plan and signing including the installation for item 2. If not then let me know by tomorrow if possible and we will have the contractor provide. The discussion was to detour traffic over a chosen weekend. Item 3 is for improving the approaches so traffic that will be crossing at this location will have more comfort. The area office will be letting me know by tomorrow if this will be absolutely necessary. I was told that when the railroad does the grade crossing that the grade could be higher or lower then existing. Item 6, TxDOT will be providing an estimate. Your City has an overpayment for construction as of today because the estimated costs (your local portion collected) were higher then the contract actual bid price. This over payment is around $3,500.00. The total extra local (20%) costs for these changes is more then the overpayment. Goodroad Department of Public Works CMAQ Program Manager 411 Elm Street, 4th Floor Dallas, TX 75202 Dear Mr. Goodroad: This letter serves as notice concerning the issues which are being discussed regarding the above referenced project, The following construction issues were not properly addressed in the plans: 1. The proposed grade crossing should have been 99 feet but was specified as 90 ~ feet. The grade crossing does not cover the walkwaya on either side of the roadway. The plans did not address the needed detours to dive~ vehicular as well as train traffic during the construction phasing, Thc plans did not provide a means of compensating the Contractor for these needed detours. 3, The plans called for necessary grade adjustments to the railroad approach but did not provide the various bid items to compensate the Contractor for this additional work. The existing unit pavers were specified to be reused on the roadway surface, however; these types of unit pavers are not acceptable to be used as a roadway surface. The new grade crossing may not conform to the required ADA regulations and the new profile may have to be adjusted, 6. According to the Standard Constr~ction Paving Details received on April 6, 2004, f the typical section requires the use of 6"reinforced concrete base, It will be necessary to provide a bid item to compensate the Contractor for this work. An Equ$1 Opportunity Employer Page 2 Letter to Dallas County April ?, 2004 The Contractor has submitted a cost estimate for Items 1 through 4 which are listed below: 1. The cost for extending the grade crossing is $2,200,00 2. The cost for the necessary detours and providing the various required traffic control items is $5,822.00 3. The cost for the necessary grade revisions is $12,611.83. This cost includes a planned removal of two and one-half inches of the existing approaches, replacing the approaches with Class C ACP at the new grade, and providing the necessary cold mix to open the lanes while the other lanes are being constructed, 4. The cost for purchasing the required pavers is $990.00. The total price is $21,623,83 not including Items 5 and 6 which only can be addressed when the field conditions warrant the situation. The acceptance and payment for this additional work is necessary to proceed with this project. TxDOT requests that this matter be addressed immediately to avoid any delay claims by the Contractor.
