Ho~~i7075 Re: City of Coppell, Texas Repainting of the Interior of the 1.5 Million Gallon Elevated Tank Gentlemen: The City of Coppell entered into a construction contract with Advantage Contract Services on February 8, 2000, for the repainting of the City's 1.5 Million Gallon Elevated Storage Tank. The project included repainting of the interior tank bowl, miscellaneous welding repairs, installation of a new motor operated valve and all SCADA System connections. The City of Coppell issued a notice to proceed to Advantage Contact Services, Inc. on March 3, 2000, which established a two-part completion date for the project as follows: · Repainting of the interior tank bowl and tank back in useful service: May 2, 2000 · Final Completion of all items of Work: June 9, 2000 Although the interior of the tank bowl was completed and the tank placed back into partial service on May 2, 2000, other critical items of work on the project remain incomplete. On June 29, 2000 the City of Coppell completed a final walkthrough of the project and prepared a list of items found to be incomplete or in need of repair. As of the date of this letter, the motor operated valve installed under this contract has no electrical power, is not connected to the SCADA System and is non-functioning. In addition, the metal grating over the covering the valve pit has yet to be modified to fit the new motor operated valve configuration. The City' s letter dated July 14, 2000 further outlined the importance of these items of work and established a date in which the City felt compelled to notify your surety company. That date has passed, critical work remains incomplete and the City of Coppell has had no indication that Advantage Contract Services intends to complete the work. Therefore, in accordance with Item 1.44 of the General Provisions of the Standard Specifications, the City of Coppell hereby declares Advantage Contract Services, Inc to be in default of the contract and directs you to immediately suspend all work on this project. July 31, 2000 Page Number 2 By copy of this letter, the City of Coppell is notifying Ms. Cheryl Humphrey of the Southern American Insurance Agency, Inc. who is the Resident Agent for the Capital Indemnity Corporation providing the surety bond for this project and hereby directs them to assume this contract within two weeks as stipulated by the contract documents.
