The easement itself is approximately 10 square feet and is only a small comer clip necessary for the connection of the Sandy Lake Road sidewalk to the sidewalk on Meadow Run. As you are aware from our meetings and fight-of-way documents provided, the City of Coppell has adequate right-of-way to construct the roadway due to right-of-way dedication when the Meadows Section One Subdivision was platted. Because of our inability to acquire the easement, the City of Coppell is rescinding its offer for the acquisition of the 10 square feet. I am advising our engineer to redesign the sidewalk connection at the comer of~your property to allow for the sidewalk to be constructed without the 10 square feet. I am sorry we were unable to come to a mutually agreeable solution for the acquisition of the comer clip and I appreciate your consideration of the City's prior offers. But again, there is no offer on the table from the City of Coppell and the City is redesigning the sidewalk construction to alleviate the need for the acquisition. The City is continuing to pursue the acquisition of the right-of-way with hopes of starting this project in the spring/1998. I have reviewed the corner clips and in lieu of trying to assign a per square foot value to the landscape easements, the City of Coppell is willing to offer a set amount for each corner clip in hopes of acquiring them without going through any other processes that involves appraisers or attorneys. Therefore, the City of Coppell is still willing to offer a set amount of $500 for each corner clip. If this is acceptable to you please sign below and return a signed copy of the letter. Once I have received the letter, I will start the process for payment of the $500 for the comer clip. Once the check has been processed we can arrange a mutually agreeable time to meet to notarize the document in exchange for the check. There are thirty parcels of right-of-way to be acquired and twelve of those parcels are referred to as "comer clips". The comer clips are necessary to allow the connection of existing sidewalks on the side streets to the proposed sidewalks along Sandy Lake Road. Your property is one of the properties on which the City of Coppell will need to acquire a comer clip. While the comer clip is on your property, it is outside of the existing entry wall. Therefore, the acquisition of the comer clip should have no adverse impact upon your property but will allow the City of Coppell the opportunity to connect existing sidewalks to proposed sidewalks along Sandy Lake Road. With this letter I am providing a copy of the easement documents. After reviewing the easement documents, if you should have any questions or if you wish to view the preliminary construction plans please contact this office at (972)304-3679 and speak with Mike Martin, Assistant City Engineer or myself. If you have no questions, the City of Coppell would appreciate the signing and returning of the easement documents so that the project can stay on track. It is anticipated that utility construction will begin sometime in mid-1997. For your convenience, my secretary is a notary public and will be happy to notarize your signature at your convenience. Box 478 Coppell, Texas 75019-4409 Re: Sandy Lake Road Project #ST 93-02 Dear Mr. Griffin: We are in receipt of your letter dated October 29, 1996 concerning the "comer clips" for connecting existing sidewalks to proposed sidewalks on Sandy Lake Road. We currently do not have a problem with the "comer clip" as it stands. However, we are very concerned about the layout of the sidewalk on Sandy Lake Road. We currently have a hedge of bushes on our property and do not want the sidewalk to interfere with those bushes in any way. It has taken 14 years for this hedge to grow and is our only buffer to Sandy Lake Road for our driveway. If we can be guaranteed that the bushes will be let~ intact ~1~ f,h~sidewalk will not be placed where the bushes are, we will sign the Permanent Right__for the corne clip" on our property.
