Item No. 6 to read:
City shall not permit any machine excavation nor allow heavy equipment to work within 10 feet either
side of Explorer's 12-inch pipeline without Explorer's field representative being present.
If you do not want to change it - that is fine.

Thank you for your e-mail.
Item #6 is to prevent any equipment working near the pipeline without an Explorer Rep. on site. Your
contractor can work near the pipeline. We just want to ensure that Explorer is notified so that someone
from Explorer is present. Please let me know if this helps. Thanks.

In reviewing the agreement - we have concerns about Item No. 6 that states:
City shall not permit any machine excavation nor allow heavy equipment to work within 10 feet
either side of Explorers 12-inch pipeline without prior approval of Explorer's field representive.
We are entering into this agreement because the city wants to construct roadway improvements

that are within 5 feet of your 12-inch pipeline. The proposed back-of-curb is 5 feet away from the
pipeline at the closest point. We know in advance that we can not construct these roadway
improvements without having paving operation equipment within 10 feet either side of the
pipeline. The paving machine extends out three to four feet beyond the back of curb.
Could Item No. 6 be reworded to state:
City shall not permit any machine excavation nor allow heavy equipment, other than the paving
operation equipment, to work within 10 feet either side of Explorers 12-inch pipeline without prior
approval of Explorer's field representive.
