Dear Mr. Griffin:
In reference to your inquiry regarding several claims on this project, the following information
should clarify the status of those claims:
1. Cargile claim dated August 20, 2000: This claim was denied. Our investigation
indicates that EBCC was not at fault.
2. Mahalik claim dated January 7, 2000: This claim has been settled by mutual
agreement between both parties.
3. Inlet Specialties: EBCC has been purchasing concrete for this subcontractor. In
accordance with our subcontract, EBCC has delayed payment until the claim notification time
period for suppliers to subcontractors has expired. The claim notifications sent to your office are
based upon their statutory requirement to notify of their intent to file a claim against EBCC's
bond. Inlet Specialties has been paid in accordance with our subcontract and prior to their
requirement to perfect a claim on EBCC's bond.
