Re: Proposal Pavement Distress Evaluation SANDY LAKE ROAD; BETWEEN MOORE AND DENTON TAP Coppell, Texas ALPHA Proposal No. 7655 Submitted herewith is our proposal to perform an evaluation of the most-probable cause of pavement distress along a portion of Sandy Lake Road (existing west-bound lane) between Moore Road and Denton Tap in CoppeH, Texas. According to the Client, the referenced section of existing concrete roadway was constructed in about December, 1999. Since construction of the pavement, distress in the form of numerous relatively small, shallow "potholes" (or "voids") measuring about 1 to 6 inches in diameter have appeared at the concrete surface. In general, the potholes (or voids) are about 0.5 to 1.5 inches deep. The Contractor (Ed Bell Construction) has recently filled some of the potholes with sealant, but other new potholes continue to appear over time. The east-bound lane of Sandy Lake Road between Moore Road and Denton Tap is presently under construction, but is not paved. The purpose of this study is to identify the most-probable cause of pavement distress and provide recommendations for repair. It should be recognized that although the proposed scope of work outlined below is intended to provide sufficient data to identify the most-probable cause of pavement distress, it is possible the proposed scope work may not be totally sufficient and other investigative work (such as an ultrasonic survey, etc.) may be required. If the required scope of work is beyond that described herein, the Client would be contacted for approval before proceeding with the additional work. Based on the current project information available, it is our present opinion evaluation of the most-probable cause of pavement distress would consist of three types of work: 1) Concrete Sampling and Laboratory Testing, 2) Concrete Distress Survey and 3) Observations of Concrete Placement and Material Testing. These three types of work are described in detail below. CONCRETE SAMPLING AND LABORATORY TESTING It is proposed to commence the present investigation by obtaining representative core samples of the in-place concrete for petragraphic examination. Currently, it is proposed to obtain concrete samples in three areas of pavement distress and in two areas of non-distresS. The samples would be obtained by coring the in-place concrete (3 cores per sample location) and then patching the core-holes with high-strength grout. Safety concerns will require a flagman be used to control traffic. The concrete samples would be visually examined in the laboratory and petragrahic tests would be conducted on one core sample from each of the five selected locations. The petragraphic tests are intended to evaluate the concrete mix proportions and properties as compared to the project specifications and provide evidence of abnormalities that might indicate the cause of distress. Additionally, samples of the concrete would be evaluated for unconfined compressive strength. CONCRETE DISTRESS SURVEY The second pan of the investigation would be to do,~-~unent the location, size and depth of existing potholes (voids) in two 50-f~ sections of the existing concrete pavement. One section of concrete pavement for the survey would be selected in the area of most numerous distress (near 532 Sandy Lake Road) and another section in an area of only moderate distress. The areas of pavemem distress would be documented and described sufficiently to allow a comparison of distress in the same areas at, er a given period of time (probably about 6 months). Please Note: Costs provided below do not include re-survey of the two 50-fi sections at a later date, but costs could be provided when this work is to be performed. OBSERVATION OF CONCRETE PLACEMENT AND MATERIAL TESTING The third part of the investigation would include field observations by a Registered Professional Engineer to evaluate concrete production, placement and finishing methods and procedures during a single day. It is anticipated the Engineer would spend 6 hours in the field performing observations of the concrete placemem to aid in identifying if the pavement distress can be related to methods or materials used in concrete placement. During the field observations, it is intended to obtain representative samples of the concrete mixture components for laboratory evaluation and comparison to project specifications. ESTIMATED COSTS Estimated costs to perform the above investigative study are outlined below for each pan of the work. The actual number and type of test, hours spent, etc. may vary from that described below depending on the field data collected and corresponding required alterations in the work to be performed. However, the TOTAL ESTIMATED COST will not be exceeded without the Client's written approval. In this event, the Client would only be charged for the scope of work performed. Similarly, it is possible the scope of work described above may need to be expanded to include other studies if the proposed work is not sufficient to address the most-probable cause of pavement distress. Results of the above study and laboratory tests will be utilized in the engineering analysis and the formulation of our opinions concerning the most probable cause of pavement distress and recommendations for repair. Results of our study, including the substantiating data and our opinions and recommendations, will be presented in a written report prepared by a Registered Professional Engineer. (hereinafter called ALPHA) shall perform the services defined in this contract and shall invoice the client for those rates shown on the attached fee schedules. The estimate of cost to the Client es stated in this contract shall not he considered as a firm figure, but only an estimate unless otherwise specifically stated in this contract. ALPHA will provide additional services under this contract as requested by the Client and invoice the Client for those additional sendces at standard rates. SITE ENTRY. Unless otherwise specified, the Purchaser will fumish ALPHA employees and their equipment the right-to-entry to the job site to perform the work. Reasonable precautions will be taken to minimize damage to the land from use of our equipment. If the Purchaser desires ALPHA to restore the land to the former condition, the cost of this will be added to our fee. Any damage to property on the site, other than land, due to negligence by ALPHA employees shall be paid by ALPHA and limited to actual replacement cost. SAMPLING OR TESTING LOCATIONS. The unit fees included in this proposal do not, unless otherwise specified, include costs associated with surveying of the site or the accurate horizontal and vertical locations of tests. Fmld tests or boring locations described in our report or shown on our sketches am based on specific information furnished to us by others or estimates made in the field by ALPHA employees. Such dimensions, depths or elevations should be considered as approximations unless otherwise stated in the report. If the Purchaser specifies the boring locations, we will reserve the right to deviate a reasonable distance from the locations specified unless this is specifically prohibited by Purchaser in writing. ALPHA reserves the right to terminate this contract ff site conditions prevent drillin0 at or near the desi0nated boring locations and these conditions were not revealed to us prior to submitlJng this proposal. If, in order to complete the borings to their designated depths, a re-drilling is necessitated by encountering impenetrable subsurface objects, this will be charged for at an equitably qmed on rate. REPORTS. ALPHA will furnish three copies of each report to the Client. The Client will be billed for additional copies at the rate specified in the Fee Schedule. Reports will be furnished to parties duly authorized by the Purchaser. DAMAGE TO EXISTING MAN MADE OBJECTS. It shall be the responsibility of the owner or his duly authorized representative to disclose the presence and accurate location of all hidden or obscure man made objects, relative to field test or boring locations. Our field personnel are trained to recognize clearly identifiable stakes or markings in the field, and without special written instructions, to initiate field testing, drilling and/or sampling within a few feet of each designated location, ff we are cautioned, advised or 0ivefl data in writing that reveal the presence of potential presence of underground or over, round obstructions, such as utilities, special instruction willi be given our field personnel by us. If, contrary to information given ALPHA by you, in the opinion of our field personnel there is reason to believe that there may be underground man made obstructions at the site, you and any possible interested third parties such es utility companies, will be contacted and consulted. Any additional expenses incurred by this will be billed at an equitably agreed on rate. As evidenced by your acceptance of this proposal, you agree to indemnify and save ALPHA harmless from all claims, suits, losses, personal injuries, death and property liability and resulting from unusual subsurface conditions or damages to subsurface structures, owned by you or third parties, occuring in the prosecution of proposed work whose presence and exact Ioca~ns were not revealed to us in writing, and to reimburse ALPHA for expenses in connection with any such claims or suits, including reasonable attorney's fees. INVOICES. Purchaser shall make all payments in accordance with the invoices, and payment is due upon receipt of invoice, unless agreed upon in this contract, even though Purchaser has not received any payment from Purchaser's prifldpal, if any. Invoices will be issued at least every four (4) weeks off projects of longer duration. Interest of 1.5% per month (but not exceeding the maximum rate allowable by law) will be payable on any amounts not paid within 30 days, payment thereafter to be applied to accrued interest and then to the principal unpaid amount. Any attorney's fees or other costs incurred in collecting any delinquent amount shd be paid by the Client. This contract shall not contain any provisions relating to retainage, unless specifically agreed upon in advance. ALPHA shall furnish all necessary certificates, liens, waivers, affidavits or other documents as and when requested by Purchaser, if all amounts due to ALPHA have been paid. TERMINATION. In the event that the Client requests termination of the work prior to completion of a report, we reserve the ri0ht to complete such analyses and records es are necessary to place our files in order, and where considered by us necessary to protect our professional reputation, to complete a report on the work performed to date. A termination charge to cover the cost thereof in an amount not to exceed 30 percent of all charges incurred up to the date of the stoppage of the work may, at the discretion of ALPHA, he made. ENGINEERING AND TECHNICAL SERVICES. The fees for such services are based upon all time spent on the project by engineering or technical personnel at the hourly rate of this proposal. The proposal estimate or lump sum does not cover the cost of any conferences, site visits, review of foundation plans and specifications, or other services subsequent to submittal of our report. Such additional services will be invoiced at the hourly rates. NI engineering and technical work is generally done by ALPHA's re0ular employees. Special services by other firms or consuIItants may on occasion be needed and will be invoiced as shown in our Fee Schedule. WARRANTY AND LIABILITY. Our professional services shall be performed, our findings obtained, and our recommendations prepared in accordance with 0enerally accepted engineering practices. This warranty is in lieu of all other warranties either implied or expressed. ALPHA assumes no responsibility for ifltorpreta- tions made by others based upon the work or recommendations made by ALPHA. Our liability to the Client for injury or damage to persons or property arising out of work performed fur the Client and for which le0al liability may be found to rest upon us, other than for professional errors and omissions, will be limited to our general liability insurance coverage. An insurance certificate will be fumisbed upon request. If increased insurance coverage and/or greater responsibility is required by the Purchaser, we, if specifically directed by Purchaser, will take out additional insurance (if procurable) to protect us, at Purchaser's expense. We shall not be responsible for property damage from any cause, including fire and/or explosion, beyond the amounts and coverage of our insurance. For damage on account of any error, omission or other professional ne01iOenca, our liability will be limited to a sum not to exceed $50,000 or our fee, whichever is greater. Further the Client agrees to notify any contractor or subcontractor who may perform work in connection with any design, report, or study prepared by ALPHA of such limitation of liability for design defect, errors, omissions, or professional ne0ligence, and requires as a condition precedent to their performing the work a like limitation of liability on their part es against ALPHA. In the event the Client fails to obtain a like limitation of liability provision es to design defects, errors, omissions, or professional nogli0ence shall be allocated between the Client and ALPHA, in such a manner that the ag0regate liability for ALPHA for such design to all pe~es, including the Client, shall not exceed $50,000 or the amount of ALPHA's fee, whichever is 0reater. In the event the Client makes a claim against ALPHA, at law or otherwise, for any alleged error, omissions or other act arising out of the performance of our profes- sional services, and the Client fails to prove such a claim, then the Client shaft pay all costs incurred by ALPHA in defending itself against the claim.
