The general answer to your question though is that the City will not participate in a condemnation proceeding to aquire an easement accross the adjacent property. If the owner of the adjacent property wants to talk to us about what would be required of him to develop the remaining tract of land, we would be happy to do that. In the event that an easment can not be obtained by your developer the City would work with you on a plan to construct your portion of this line and plug it at your property boundary. I have checked on the property ownership of the vacant tract to the west of the 30-acre site and the owner is not the same as the owner of the 30-acre property. Therefore, for my feasibility report, I need to know if the City would proceed with condemnation procedures to obtain a water easement for the 8" water line to loop back into the 10" water line along East Belt Line Road if the adjacent property owner does not want to grant an easement to us?
