Main Street Lewisville, TX 75057 Re: Excavation at Hidden Valley Estates Dear Sir: My wife and I own a home that is adjacent to the northern boundary of your Hidden Valley Estates development. The excavation done by Cooper Excavation at that site has resulted in significant damage to our property. Safety hazards have been created and allowed to exist, also. Based on what we see being done we are concerned that your plans for this excavation have the potential to result in further serious degradation to our property and additional safety issues. We are concerned and disappointed that you have not seen fit to share your plans with us before now, as we have obviously been affected and are likely to be in the future. We wish to meet with you and discuss this matter immediately. We want to know how you propose to correct the damage done so far and how you will prevent further damage and disruption to our property in the future, both during and after completion of the current and any future planned construction. Specifically, we need to learn how you will accomplish the following: 1. Correct the subsidence and erosion damage to the land, fence, and landscape along the common line between our properties. 2. Establish and maintain safe conditions at the excavation sites adjacent to our property without encroaching on or interfering with access to our property. 3. Prevent additional erosion and subsidence damage to our property during excavation and construction. 4. Prevent degradation of the drainage profile of our property during excavation and construction. 5. Provide support for the soil of our property to prevent long-term disruption of the grade and stability of the property after completion of construction. 6. Prevent degradation of the drainage profile of our property after completion of construction. 7. Compensate us for our inconvenience and costs resulting from the impact of your activities so far. Ordinarily we would expect the expertise of your engineering company and you to be sufficient to accomplish these objectives without our involvement or intervention. Events of the last few days, however, have caused us to question if this is a realistic expectation. We need some assurance from you that you are going to do the right thing in correcting the problems and respecting our property rights as you proceed with your project. We wish to see you succeed with your development and are hopeful that the results will be profitable for you as well as beneficial for us in terms of improving property values resulting from our proximity to the fine homes we are sure you will build.
