Houston, Texas 77075 Re: City of Coppell 1.5 Million Gallon Elevated Storage Tank Repaint Gentlemen: We are in receipt of your facsimile transmission dated April 26,2000 outlining your schedule for completion of the repainting of the City of Coppell 1.5 Million Gallon Elevated Storage Tank. Your schedule now shows a completion date of May 12, 2000. As a reminder, the contract time for having the tank operational, in service and available to the City for use expires on Tuesday May 2, 2000. This date was as established in the notice to proceed issued on behalf of the City of Coppell by our office on March 3, 2000. As outlined in the project specifications and discussed in the pre-construction conference, this facility is vitally important to the safe and proper operation of the City of Coppell's water distribution system. Water demand in the system is increasing daily and having this tank in service is essential. Please re-visit your project schedule and work towards meeting the original project completion date. In accordance with the contract documents, for each day the tank remains out of service beyond the May 2, 2000, liquidated damage accrue at the rate of $500 per day. M r. Kenneth M. Griffin, P.E.
