Dear Mr. Holland:
The purpose of this letter is to officially notify MASTEC of a situation concerning the sewer line project that
you are currently performing for and on behalf of the city of Coppell. As you are most likely aware, while
conducting boring operations in the vicinity of Lakeside Elementary School on MacArthur Boulevard in
Coppell, MASTEC employees cut a fiber optic network line owned by the Coppell Independent School District
(CISD).
Mr. Robbie Dupree, the Operations Manager for MASTEC on this project, has discussed this issue with
representatives from CISD and our office on several occasions in an attempt to resolve this issue in a manner
satisfactory to all parties involved. Unfortunately, no resolution has presented itself to date.
It is our understanding that the CISD will proceed with repairs to their network, in order that they can ensure
operability of the network in time for the arrival of staff in the next few days in preparation for the upcoming
school year. The CISD will no doubt forward a claim to the city of Coppell. The existing contract between
MASTEC and the City states that any damage occasioned by MASTEC operations will be that company's
responsibility. Hence, any claim filed will be forwarded to MASTEC in accordance with our contract.
It is the position of the city of Coppell that MASTEC should pay or finalize a resolution of this matter within 15
days of receipt of any claim. Your contract with the city of Coppell clearly provides that MASTEC is
responsible for the repair or payment of all damages to all existing utilities caused by its operations on public or
private property, whether it be below or above ground. We are aware that there is disagreement between the
contractor employed by the CISD to effect repairs and your Company regarding the costs associated with the
repairs. In any event, it is the city of Coppell's position that MASTEC is obligated to resolve all issues
necessitated by the damage to the fiber optic line. We will pledge our cooperation in order to facilitate a quick
and equitable resolution of this matter.
