Dear Mr. Pavolvich:
The City of Coppell has made several site visits for the purpose of inspecting for compliance based
on the above project's Trench Safety Plan. An inspection made today indicated you were not in
compliance with OSHA regulations, City of Coppell ordinances or your submitted and approved
trench safety plan at the Forest Hill Drive location of a sanitary sewer manhole installation.
On three previous occasions including yesterday, you were instructed to utilize a safety device in the
trench. Today a worker was observed by City of Coppell Fire Department personnel in the trench
without proper safety equipment in use. The battalion chief who observed the noncompliance had
just returned from working at the scene of a fatal trench accident that occurred yesterday afternoon
in Collin County. Compliance with regulations was attained by mid-afternoon at the Forest Hill
location.
Following the approved Trench Safety Plan at all times is necessary to compliance and must be
practiced at all times. In order to continue work at the location, you must demonstrate a
commitment to the safety of your workers. I will be happy to discuss this with you if you need
further clarification of the requirements.
