COFFELL October 6, 2003 RE: Bethel Road l / Project # ST 99-05 Parcel 3 - Right-of-Way Parcel 3E - Slope Easement Parcel 3El - Temporary Construction Easement Dear Mr. Futerfas: This letter is a follow-up to the August 11, 2003 letter concerning the acquisition of right-of-way from your property located along Bethel Road. Walter Hogg, PS is owner of what is shown as Parcel 3 on the construction plans for the Bethel Road improvements. In order to construct the improvements, it will be necessary to acquire right-of-way, a slope easement, and a temporary construction easement from Parcel 3. The right-of-way, slope easement, and temporary construction easement are contiguous with the existing right-of-way along the south property line of Parcel 3. In your telephone call on September 30, you had several questions related to the right-of-way acquisition. The two parcels of land east of your parcel, CiCi's Addition No. 1 and Gulf Bearing, Inc., dedicated 12 foot of right-of way when they were platted. This was in addition to the 20 foot of right-of-way dedicated as part nf the original Freeport North plat in 1984. The proposed _+30-foot right-of-way acquisition on your parcel matches the right-of-way already acquired along the north side of Bethel Road. There is an Explorer Pipeline easement containing a 12-inch pipeline on the DFW Airport property south of Bethel Road. The proposed back-of-curb cannot be within five foot of the centerline of the pipeline, preventing the roadway from being located further to the south. In addition to the fight-of-way acquisition on the north, the City is acquiring right-of-way, varying in width from 11 to 40 feet, from the DFW Airport. The Tree Ordinance can not be waived 'ahen the property is developed. The City of Coppell is offering $0.79 per square foot for the permanent right-of-way and $0.20 per square foot for the temporary construction easements. Slope easelnents and temporary construction easements are typically acquired at one-fourth the value of right-of-way. These easements are not filed with Dallas County and will expire upon completion of the project by the City. This letter constitutes an offer from the City of Coppell for the acquisition of the right-of-way and temporary construction easements as follov,,s: 1. Acquisition of permanent right-of-way at $0.79/sq. ft. x 39, i 13 sq. ft. 2. Acquisition of slope easement at $0.20/sq. ft. x 1,268 sq. ft. 3. Acquisitiou of temporary construction easement at $0.20/sq. ft. x 12,154 sq. ft. $ 30,899.27 $ 253.60 $ 2,43O.8O Total $ 33,583.67 Construction is scheduled to start in Apfil 2004 and we need to acquire the necessary right-of-way as soon as possible. Enclosed are copies of the right-of-way and temporary construction easement documents. If the above offer is acceptable, please sign below and return to this office. Once the letter is received, the process for payment of the $33,583.67 can start. When the check is ready we can arrange a mutually agreeable time to meet and notarize the documents in exchange for the check.
