Dear Mr. Futerfas:
This letter is written as a follow-up to our recent telephone conversation concerning several outstanding
issues associated with the acquisition of right-of-way, slope easement, and temporary construction
easement from your property located along the north side of Bethel Road. Specifically, you had three
areas of concern which included: 1) the extension of a waterline; 2) the length of time that the
construction easement was needed; and 3) the purpose of the slope easement.
Hopefully, the following ,,','ill explain in detail the three areas of concern.
1. Currently, a 16" waterline exists in Bethel Road at the southeast comer of your property. The City's
Water and Sewer Master Plan shows that water line should be extended to the west side of your
property. Therefore, we have instructed the engineer for the project to include the extension of the
16" waterline to your west property line. It is necessary to extend the waterline at this time because it
ts within the right-of-way of Bethel Road.
2. The temporary construction easement is needed f(Jr the manuervability of the equipment and short-
ten'n storage of some materials in the xvorking area. The length of time for the temporary
construction easement is 18-months after the start of construction on the project. It is anticipated that
the project will begin in early 2005 and be complete by mid-2006.
3. The slope easement is necessary to provide proper sloping from the proposed back of curb to the
ex~sting ground on the north side. The City of Coppell is lowering the road between 2 [/2 and 3 feet
adjacent to the southwest corner of your property. The slope easement allows us to provide a flat area
adjacent to the street for future sidewalks and then slope from that point back up to the natural ground
of your property. Without the slope easement there would be an abrupt grade change from the right-
of-way to your property. As I stated m our telephone conversation, the slope easement is not filed
with the County, but is held in thc Engineering Department. When this property develops, there will
be grade changes associated with the development that typically negates thc need for the slope
easement. If the slope easement were filed with the County, then there would need to be another
process, at development, to remove the slope easement ii-om the property.
In addition to the above, all items from the September 16, 2004 letter are still valid. This letter constitutes
an offer from the City of Coppell for the acqmsition of right-of-way, slope easement and temporary
construcnon easement as follows:
'1. Acquisition of permanent right-of-way at $3.15/sq. ft. x 39, l 13 sq. ft. 123,206.00
2. Acquisition of slope easement at ($3.15/sq. ft. x 1268 sq. ft.) x 25% 998.00
3. Acquisition of temporary construction easement at ($3.15/sq.ft. x 12,154 sq. ft.) x 5% 1,915.00
4. Construction of 8" sanitary sewer line by City of Coppell (estimated value $55,000) -55,000.00
5. Extension of 16" waterline from southeast comer of property to southwest
comer of property.

If the above offer of $7I,I 19 cash, the construction of an 8" samtary sewer line to your property, and the
extension of the 16" waterline adjacent to your property is acceptable to you please sign below and return
a copy of this letter to my office. Once a s~gned copy is recetved, the process for payment of the $71,119
can begin. When the check is ready, we can arrange a mutually agreeable time to meet and notarize the
documents in exchange for the check.
