Historically, the Texas Department of Tran~oort~tlon (department) has financ~ highw~
projacts on a "pay a~ you ~o" basis, using motor fuel taxus and other revenue deposited in tho ste~e
highway fund. However, with limited slate transportation foudhtg and an ir~rease in population that
is projected to grow from 20,9 miUion in 2000 to 29,6 million by 2025, this "pay as you go" method
of financing is not able to keep pace with the growing tranqxa'tatlon demand, From 1990 to 2000,
vehicle miles traveled increased by forty-one percent, while only about three percent more Inne miles
were added to the ~ate highway system. In addition, continued eonipestion in Texas metro@olit~n
ares~ is costing the stere billions of dollars of wasted time and fuel.
'Fronsponntlon Code. Chapter 361 authorizes the department to s~udy, design, construct,
operate, ~xpand, enlarge, or extend a turnpike project as a pm't of the s~te highway system,

The Texas Transportation Commission (commission) recognizes that inno~

implement guidelines for evaluating mobitity projec4s on the state highway systeu for development
as toll roads.
IT IS FURTHER ORDERED that these guidelines include the following:
