Request for Time Extension
Dear Mr. Hoff:
This letter is written in response to your January 13, 2005 letter in which you requested an extension of fifty-one
(51) days. That request cannot be acted upon because all required information has not been submitted. The
contract (on page 3-6 of the Standard Specification Supplementary Conditions) states "No extension of the
contract time shall be allowed unless the CONTRACTOR can demonstrate the delay caused an adverse impact to
the critical path and that loss of time cannot be made-up by revising the sequence of the work of the project."
Your letter references several items related strictly to relocation of utilities. However, the contract requires that
you review your entire Project Schedule to ascertain whether or not the requested extension can be made-up by
revising critical path items. Again, before the request can be acted upon you need to revise and resubmit a Project
Schedule similar to the one you provided on November 15, 2004, ~vhich list ail project components and the
estimated time. That ProJect Schedule should dearly denote the critical path items so that a decision can be
provided.
Also, please be advised that the Project Schedule you previously submitted shows that at least twenty-seven (27)
days were being dedicated to powerline, cable and fiber optic relocations. So at a bare minimum, the only
extension the City would consider would be an extension over and above the time already noted in your schedule
allocated for those items. Again, that decision cannot be made until a revised schedule has been provided per the
contract.
The last sentence of your letter states that 27% of the requested days have been "weather days". Please be advised
that no consideration is provided for "weather days" in a contact in which it is bid strictly as "calendar days".
If you have any questions or need any additional information please feel free to contact this office. If not, the City
will await the submittal ora revised Project Schedule showing critical path items befbre it acts upon your request.
