This letter is written in response to the final extension approved on October 29, 2003 for
corrections to the referenced Sandy Lake Road project. First and foremost let me stress that the
Sandy Lake Road project from Denton Tap Rd. to MacArthur Blvd. is not yet complete. The City
of Coppell has not paid the final payment on this project and we continue to have ongoing
negotiations with the original contractor, Ed Bell Construction Company. Because the project is
still an open project and there are still unresolved issues with the workmanship on the project and
the quality of some of the paving placed in 1999, we cannot closeout this project until xve come to
resolution with the original contractor. This severely limits the City's ability to bring in a second
contractor to start removing and replacing portions of the project that are noncompliant.
My most recent meeting with the original contractor was on January 20, 2004 in which we again
discussed substandard pavement that the City has refused to pay for and discussed incorrectly
constructed ramps at various locations. The original contractor, Ed Bell Construction Company,
indicated that they would be moving into the area to begin removal and replacement of some of the
ramps that have been noted to be noncompliant. However, they have indicated that they will not be
removing any of the accessible routes that are noncompliant.
It is their opinion that the consulting engineering who designed the project, Kimley-Hom,
incorrectly designed the cross-slopes of the accessible routes. In reviewing the construction plans,
there are several areas where the accessible route is designed to have a 6% or greater cross-slope.
This exceeds the 2% maximum allowed.

4.3 ACCESSIBLE ROUTE 4.3.7 SLOPE
VIOLATION
1) The accessible route (sidewalk) which connects to
the curb ramp on the east side of the main driveway
entrance to Kroger located on the north side of
Sandy Lake in the 900 block has a cross slope of
6.1%.
2) The accessible route (pavestone crosswalk)
between the two curb ramps at the main driveway
entrance to Kroger located on the north side of
Sandy Lake in the 900 block has a cross slope of
5.6%.
3) The accessible route (sidewalk) which connects to
the curb ramp on the west side of the main driveway
entrance to Kroger located on the north side of
Sandy Lake in the 900 block has a cross slope of
8.6%.
4) The accessible route (pavestone crosswalk)
between the two curb ramps at the west driveway
entrance to Kroger located on the north side of
Sandy Lake in the 900 block has a cross slope of
6.8%.
5) The accessible route (crosswalk) between the two
curb ramps on either side of Meadow Glen located
on the north side of Sandy Lake has a cross slope
that varies from 3.4% to 4.6%.
6) There is a portion of accessible route (sidewalk)
that connects to the curb ramp on the east side of
Meadow Glen on the north side of Sandy Lake that
is approximately 5 ft. in length with a slope that

SOLUTION
This issue will be resolved with the installation o£
new ramps, as noted in 4.3.7(1).

Upon field investigation, the accessible route
appears to be within tolerance. Request this
comment be removed.
4.27.2 CLEAR FLOOR SPACE

the southeast comer is 11.3%.

4.27.2 CLEAR FLOOR SPACE
16) The clear floor space required for the pedestrian
crossing button located on the southeast comer of
Old Denton Tap and Sandy Lake is a grassy area
approximately 12 feet back from the paved surface
and has a slope of 14.6%.
The southeast comer of the intersection of Denton
Tap and Sandy Lake was not part of this
construction project. Our project commenced
approximately 150 feet east of that area.

Sandy Lake Road existed as a 20-foot asphalt roadway with fully developed subdivisions and
commercial properties adjacent to it for it's entire length. The roadway was part of the City of
Coppell's Thoroughfare Plan. To accommodate increased traffic, the roadway was widened to a
4-lane divided boulevard. So, what existed as a 20-foot asphalt roadway became an
approximately 70-foot wide roadway i.e., approximately 50-feet wider. The existing
development along Sandy Lake Road was already developed lower than the existing asphalt
roadway from approximately Denton Tap Rd. to Lodge Rd. The existing development along the
north side of Sandy Lake Rd. from Moore Rd. to MacArthur Blvd. was already developed
substantially higher than the existing asphalt roadway. When the road cross-section was extended
from approximately a 20-foot wide asphalt roadway to a 70-foot wide 4-1ane divided boulevard,
the slopes required to come back to existing development on both sides of the roadway was
worsened. Because of these design constraints where a road was being constructed through a
fully developed area, the City of Coppell is requesting variances for the following items.

As previously stated, the City of Coppell fully intends to comply with the above items listed in
Section A, once the original contractor for Sandy Lake Road has resolved his issues and the City
has finaled the project. Prior to the project being finaled, the City cannot introduce another
contractor onto the project. Once a ruling has been made on the items requested for variance in
Section D, the City will comply with ADA requirements in making any adjustments necessary. I
will notify you at such time as the City has finaled the project to alert you to the fact that we will
be hiring a contractor to address the items listed above.
