The ninety-day timeline for corrections on this project is set to expire on June 16, 2004. On April 30, 2004, the City of Coppell entered into a contract with Ed Bell Construction Company to resolve all associated ADA issues. It xvas our hope to have this project completed by thc first part of June; however, with the weather related work stoppages, the contract will more than likely not be complete until the end of June, 2004. Currently, the contractor is approximately 60% complete on all ADA issues. With this letter, I am providing a copy of our agenda item that went to City Council on April 30, 2004, along with a detailed breakout o£the cost associated to correcl each location. The locations that have a dash mark attached to them have no cost assigned to the city because they were constructed incorrectly by the contractor and will be removed and replaced at the contractor's sole cost. One issue that delayed the resolution of the ADA deficiencies xvas working xvith the original design consultant on liability. The liability issue is now resolved. Included with this letter is a letter from the design consultant, dated April 27, 2004, in which they agreed to pay $35,000 of the ADA related issues. Once the project has been completed, I will send verification to the Slate that all deficiencies have been corrected. Because of the fact that the City does have a contract in place to correct all deficiencies, and the complications surrounding this matter associated with responsibility for submitting plans to the State, it is my hope that no administrative penalties will be accessed against the City of Coppell.
