Staten, Jr. 14522 Cyprus Point Drive Farmers Branch, Texas 75234-2205 September 9, 2004 S.H. 121 Water Line / WA 01-01 Permanent Water Line Easement Dear]Mr. Staten: This letter is a follow-up to the August 12, 2004 letter and thc ensuing meeting concerning the acquisition of a 15-foot permanent water line easement from your property located at the intemeefion of Coppell Road and S.H. 121. The easement is necessary for the construction of a 12-inch water line that was identified as a deficiency in the Water Distribution Master Plan. The 15-foot utility easement would be adjacent to the S.H 121 fight-of-way and would have limited impact upon future development of the property as typically required setbacks, landscaped areas, etc. are allowed within the utility easements. During the meeting you expressed concern about having to mitigate for trees within the utility easement that subsequently die as a result of the construction. The Parks and Recreation Department requires developers to mitigate for tree removal at the time the property is developed. They do not require any mitigation for trees that die on a property prior to being developed. The City of Coppell is offering $1.05 per square foot for the permanent water line casement. Permanent utility easements are usually acquired at one-half of the land value as shown in the Dallas Central Appraisal District. This letter constitutes an offer from the City of Coppell for the acquisition of the easements as follows: 1. Acquisition of permanent water line easement at $1.05/sq. ft. x 7,929 sq. ft. $8,325.45 Construction is scheduled to start in the 4th quarter of 2004 and we need to acquire the necessary easement as soon as possible. Enclosed is a copy of the easement documents. If the above offer is acceptable, please sign below and return to this office. Once the letter is received, the process for payment of the $8,325.45 can start. When the check is ready, we can arrange a mutually agreeable method to exchange the documents and the check.
