KNOW ALL MEN BY THESE PRESENTS

known herein as GRANTOR, in consideration of the su/n of Ten and
other good and valuable consideration paid by the City of Coppell, Texas, a municipal corporation
o£ Dallas County, Texas, receipt of which is hereby acknowledged, does hereby grant, bargain, and
convey to said City (GRANTEE), it successors and assigns, a permanent right-of-way and the flee
and uninterrupted use, liberty and privilege of passage in, along, upon and across the following
described property owned by Grantor (the "easement strip") for the purpose of right of way across
Grantor's main tract with the right and privilege at all times, of the GRANTEE herein, its agents,
employees, workmen and representatives having ingress, egress, and regress in, along, upon and
across said premises (the "easement strip") for the purpose of making additions to, improvements
on and repairs to any part thereof.
Said easement strip being described in Exhibits "A" and "B" attached hereto and made a
part hereof for all purposes.
That in consideration of the benefits above set out, Grantee will remove from the easement
strip, such fences, buildings and other obstructions as may be found upon said property. After
construction has been completed or after any entry for repairs or maintenance, GRANTEE shall,
except for removed obstructions, return the surface area o£ the easement strip to its original
condition as nearly as practical taking into consideration the nature of the work being performed.
GRANTOR reserve the right to use and maintain the surface of the easement strip for purposes
which will not interfere with GRANTEE'S rights hereby granted and agree that, GRANTEE shall
not be obligated for future maintenance and upkeep of the surface area.
TO HAVE AND TO HOLD unto the City of Coppell, Texas, its successors or assigns for
the purposes aforesaid, the premises above described.

BEING 524 square feet of land situated in the David Meyers Survey, Abstract No. 886 in the
City of Coppell, Dallas County, Texas, and being part of a tract of land described as Tract
Three and Tract Four in a deed to Rains Custom Developments, Inc. being executed on June
15, 2000, as recorded in Volume 2000124, Page 1835 of the Deed Records of Dallas
County, Texas, and being more particularly described by metes and bounds as follows:
Commencing at the north corner of said Tract Four and the east comer of a called 0.7620
acre tract described as Tract 2 in said deed to Rains Custom Developments, Inc. as recorded
in Volume 2000124, Page 1835 of said Deed Records;
Thence, South 51 degrees 31 minutes 00 seconds West, along the common line of said
Tract Two and said Tract Four, a distance of 311.00 feet to a five-eighths inch iron rod found
at the west comer of said Tract Four and in the existing northeast right of way line of Sandy
Lake Road for the POINT OF BEGINNING, said iron rod also being the south comer of said
Tract Two and being located at a distance of 49.75 feet Left from centedine station 38+08.35
as shown on Dallas County's 1991 Bond Program Right of Way plans on file at the Dallas
County Public Works Department;
1. THENCE, North 51 degrees 31 minutes 00 seconds East, along the common line of said
Tract Two and said Tract Four, a distance of 5.58 feet to a one-half inch steel rebar with
yellow plastic cap marked "AB&A", set on the proposed northeast dght of way line of
Sandy Lake Road;
2. THENCE, South 53 degrees 29 minutes 06 seconds East, along the proposed northeast
dght of way line of Sandy Lake Road, a distance of 100.02 feet to a one-half inch steel
rebar with yellow plastic cap marked "AB&A", set on the common line of said Tract Three
and a called 0.5450 acre tract of land described in a deed to Robert King and wife,
Heather King as recorded in Volume 2000002, Page 5434 of said Deed Records;
3. THENCE, South 51 degrees 31 minutes 00 seconds West, along said common line, a
