KNOW ALL MEN BY THESE PRESENTS
THAT the term Grantor used herein shall be construed in the singular or plural
number as such term respectively represents one or more than one person.

herein after referred to as GRANTORS, in consideration of the sum of Ten and no/100 Dollars
($10.00) and other good and valuable consideration in hand paid by City of Coppell, Texas, receipt
of which is hereby acknowledged, does by these presents grant, bargain, sell and convey unto City
of Coppell, Texas, ("GRANTEE"), the flee and uninterrupted use, liberty and privilege of passage
in, along, upon and across the following described property owned by Grantor for the purpose of a
slope easement for grading, sloping or filling along, upon and across said property to provide a
more subtle grade change transition, across Grantor's main tract with the right and privilege at all
times, of the GRANTEE herein, its agents, employees, workmen and representatives having
ingress, egress, and regress in, along, upon and across said premises for the purpose of maintaining,
making additions to, improvements on and repairs to the said slope easement or any part thereof.
Said slope easement strip being described in Exhibits "A" and "B" attached hereto and made
a part hereof for all purposes.
After construction has been completed or after any entry for repairs or maintenance,
GRANTEE shall, except for removed obstructions, return the surface area of the easement strips to
its original condition as nearly as practical taking into consideration the nature of the work being
performed. GRANTORS reserve the right to use and maintain the surface of the slope easement
strip for purposes which will not interfere with GRANTEE'S rights hereby granted and agree that,
GRANTEE shall not be obligated for future maintenance and upkeep of the slope easement strip.
TO HAVE AND TO HOLD unto the City of Coppell, Texas, its successors or assigns for
the purposes aforesaid, the premises above described.

BEING 1140 square feet of land situated in the David Meyers Survey, Abstract No. 886 in the
City of Coppell, Dallas County, Texas, and being part of a called 0.545 acre tract of land
described in a deed to Henry H. Tate being executed on October 1, 2001, as recorded in
Volume 2001231, Page 04680 of the Deed Records of Dallas County, Texas, and being
more particularly described by metes and bounds as follows:
Commencing at the east corner of said Tate tract and the north corner of a called 0.6120
acre tract described in deed to Patsy Ann Phillips as recorded in Volume 80067, Page 3011
of said Deed Records;
Thence, South 44 degrees 03 minutes 30 seconds West, along the common line of said Tate
tract and said Phillips tract, a distance of 249.94 feet to a one-half inch steel rebar with yellow
plastic cap marked "AB&A", set for corner on the proposed northeast right of way of Sandy
Lake Road;
Thence, North 53 degrees 29 minutes 06 seconds West, along the proposed northeast dght
of way of Sandy Lake Road, a distance of 74.82 feet to a one-half inch steel rebar with yellow

POINT OF BEGINNING, said steel rebar being located at a distance of 55.00 feet left from
centedine station 39+47.99 as shown on Dallas County's 1991 Bond Program Right of Way
plans on file at the Dallas County Public Works Department;
1. THENCE, North 53 degrees 29 minutes 06 seconds West, continuing along the proposed
northeast dght of way line of Sandy Lake Road, a distance of 38.00 feet to a one-half
inch steel rebar with yellow plastic cap marked "AB&A", set on the common line of said
Tate tract and a tract of land described as Tract 3 in a deed to Rains Custom
Developments, Inc. as recorded in Volume 2000124, Page 1835, of said Deed Records;
2. THENCE, North 51 degrees 31 minutes 00 seconds East, along the common line of said
Tate tract and said Rains tract, a distance of 31.06 feet to a one-half inch steel rebar with
yellow plastic cap marked "AB&A" set for comer on the proposed slope easement;
3. THENCE, South 53 degrees 29 minutes 06 seconds East, along the proposed slope
easement a distance of 38.00 feet to a one-half inch steel rebar with yellow plastic cap
marked "AZB", set at the East comer of the proposed slope easement;
