THAT, the CITY OF CARROLLTON, TEXAS, a municipal corporation of Dallas
County, Texas acting by and through the undersigned, their duly authorized representative, known
herein as GRANTOR, for and in consideration of up to two future access points in conformance
with the City of Coppell standards and the sum ofTen and No/100 Dollars ($10.00) and other good
and valuable consideration in hand paid by the CITY OF COPPELL, TEXAS, receipt of which is
hereby acknowledged, does by these presents grant, bargain, sell and convey unto said City,
("GRANTEE"), the free and uninterrupted use, liberty and privilege of passage in, along, upon and
across the following described properly owned by Grantor (the "Drainage Easement") for the
purpose of constructing and maintaining an underground drainage system across Grantor's main
tract with the right and privilege at all times, of the GRANTEE herein, its agents, employees,
workmen and representatives having ingress, egress, and regress in, along, upon and across said
Drainage Easement for the purpose of making additions to, improvements on and repairs to said
drainage system or any part thereof.
Said Drainage Easement being described in Exhibits "A" and "B" attached hereto and made
a part hereof for all purposes.
That in consideration of the benefits above set out, GRANTEE will remove from the
Drainage Easement, such fences, buildings and other obstructions as may be found upon said
property. After construction of the underground drainage system has been completed or after any
entry for repairs or maintenance, GRANTEE shall, except for removed obstructions, return the
surface area of the Drainage Easement to its original condition as nearly as practical taking into
consideration the nature of the work being performed. GRANTOR reserves the right to use and
maintain the surface of the Drainage Easement for purposes which will not interfere with
GRANTEES rights hereby granted and agree that upon completion of the underground facility and
restoration of the surface, GRANTEE shall not be obligated for future maintenance and upkeep of
the surl~ace area.
TO HAVE AND TO HOLD unto the City. of Coppell, Texas, its successors or assigns for
the purposes atbresaid, the premises above described.

Legal Land Description for Parcel 16DE
BEING 2,622 square feet of land situated in the David Meyers Survey, Abstract No. 886 in
the City of Coppell, Dallas County, Texas, and being part of a called 24.153 acre tract
described in a deed to the City of Carrollton, Texas being executed on November 14, 1991
as recorded in Volume 91226, Page 0332 of the Deed Records of Dallas County, Texas, and
being more particularly described by metes and bounds as follows:
Commencing at an interior comer of said City of Carrollton tract and the east corner of a
called 0.6120 acre tract described in a deed to Patsy Ann Phillips as recorded in Volume
80067, Page 3011 of said Deed Records;
Thence, South 51 degrees 31 minutes 00 seconds West, along the common line of said City
of Carrollton tract and said Phillips tract, a distance of 170.03 feet to a one-half inch steel
rebar with yellow plastic cap marked "AB&A", set for corner on the proposed northeast right
of way of Sandy Lake Road;
Thence, South 53 degrees 29 minutes 06 seconds East along the proposed northeast right
of way line of Sandy Lake Road, a distance of 130.10 feet to a one-half inch steel rebar with
yellow plastic cap marked "AZB", set for the west corner of the proposed drainage easement
for the POINT OF BEGINNING, said steel rebar being located at a distance of 55.00 feet left
from centerline station 42+67.24 as shown on Dallas County's 1991 Bond Program Right of
Way plans on file at the Dallas County Public Works Department;
1. THENCE, North 36 degrees 30 minutes 54 seconds East, along the northwest line of the
proposed drainage easement, a distance of 25.00 feet to a one-half inch steel rebar with
yellow plastic cap marked "AZB", set for the north corner of the proposed drainage
easement;
THENCE, South 53 degrees 29 minutes 06 seconds East, along the northeast line of the
proposed drainage easement, a distance of 105.30 feet to a one-half inch steel rebar with
yellow plastic cap marked "AB&A", set on the common line of said City of Carrollton tract
and a called 0.2950 acre tract described in a deed to Rex Brooks as recorded in Volume
78194, Page 3797 of said Deed Records;
3. THENCE, South 38 degrees 30 minutes 00 seconds West, along the common line of
said City of Carrollton tract and said Rex Brooks tract, a distance of 25.02 feet to a one-
half inch steel rebar with yellow plastic cap marked "AB&A", set on the proposed
northeast right of way line of Sandy Lake Road;
