T H E - C I T Y · 0 F CO-PP-ELL February25,2002 Peter Park P.O. 803209 Dallas, TX 75380 RE: Sandy Lake Road Project (MacArthur Blvd. to east City Limits) #ST 93-01 Parcels 24, 24 SE, 24 DE1, & 24 DE2 Dear Mr. Park: I apologize for the delay in bringing to resolution the acquisition of right-of-way from your property. However, as we were finalizing the construction plans it became apparent that a drainage easement was also needed from your property. After much negotiation with the consulting engineer for this project, we did finally receive legal descriptions for the drainage easement on February 7, 2002. We typically acquire drainage easements at approximately one-half the value of the right-of-way purchased. In this case, that would mean that the drainage easements would have a value of one dollar per square foot. However, the consulting engineer did not revise the slope easements for this property. In other words, we are still acquiring the same size slope easement as we previously were. However, we are overlaying a portion of the slope easement with a drainage easement in two locations. Therefore, we are paying $.40 / per sq. foot for the slope easement that is beneath the drainage easement and an additional $.60 / per sq. foot for the drainage easements. In effect, this creates a value of $1.00 / per sq. foot for the two drainage easements. I would be happy to discuss this and explain it further with you if you wish. Drainage Easement 24DEl is necessary to discharge water from the subdivision to the south into the existing drainage ditch across your property. Drainage easement 24DE2 is necessary to collect water from your side of the road and discharge it to the south. The total difference in the previous offer, which you agreed to, and this offer is an additional $2,541 for the drainage easements over the top of the proposed slope easements. The total offer from the City of Coppell to you for acquisition of right-of-way, slope easements and drainage easements is now $110,295.00. Also, as we previously agreed to, if the sewer line to serve your property is designed prior to the time that the project is bid for construction then the City will include your engineer's design with our contractor. Once the bids are open, but prior to the award of the bid to the contractor, the City will require you to pay to the City the bid amount for the sanitary sewer line extension to your property. If at that time you choose not to fund the extension of the sanitary sewer line to your property then that portion of the project will be deleted and the City will then award the balance of the Sandy Lake Road project to the low bidder. 255 PARK WAY ~ PO BOX 478 ~ COPPELL TX 7~019 ~ TEL 972/462 0022 ~ FAX 972/304 3673 The following represents the revised offer from the City: 1. Acquisition of Parcel 24 at $2.00/sq. ft. x 43,702 sq. ft. 2. Acquisition of Parcel 24SE temporary slope easement at $0.40/sq. ft. x 50,875 sq. ft. 3. Acquisition of Parcels 24DE 1 & 24DE 2 drainage easements at $0.60/sq.ft. x 4,235 sq. ft. 4. Extension of two 8" water lines constructed from the existing 12" waterline on the south side of Sandy Lake Road to the new north right-of-way of Sandy Lake Road by the City of Coppell. $87,404.00 $20,350.00 $2,541.00 Total $110,295.00 If this revision to include the two drainage easements is acceptable to you, please sign below and return to me. Once I have received the letter I will start the process for payment of the $110,295.00. When the check has been processed we can arrange a mutually agreeable time to meet to notarize the documents in exchange for the check. I have included copies from the consulting engineer which show the locations of proposed drainage easement number #1 and #2. Again, I apologize for the delay in making a revised offer to you.
