This letter shall serve as a follow up to our meeting on Monday, October 18, 2004. In
accordance with our meeting, the Affidavit of All bills Paid and Consent of Surety for
Final Payment were delivered to your office yesterday. The two year maintenance bond
was also delivered to you yesterday but, this morning we received a phone call from your
office and we were informed that the amount shown on the bond was incorrect. The
amount shown was more than what it is suppose to be. We are in the process of getting
this corrected and having a revised bond delivered to your office this afternoon. We hope
that this will be acceptable to you.
The as-built draxyings were hand delivered to Turner, Collie & Braden, Inc. first thing
this morning.~/They should have them now. In addition, the HDPE directional drill
infor~afio~ that they requested was faxed to them this morning. They should have all of
the information that they need.
Lastly, the ISCO Industries letter that you received was "not a lien" but, only a "notice to
Owner or Contractor - Balance Due". All invoices have been paid at this time and a
formal lien was never filed. I have requested a letter or fax from ISCO confirming this
but, I have not yet received it. I will forward you a copy for your records when I receive
it. We have signed an Affidavit of All Bills Paid and there was never a lien to be released
from. The City should have what is necessary to issue final payment. Please let us know
if things will change from what was discussed in our meeting. Thanks for your help.
