Dear Mr. Jacobson:
As you are aware the construction of the referenced development involves breaching an
existing stock tank and rerouting the drainage through the site. The City of Coppell has
the following concerns:
I. We are in receipt of the determination from the Army Corps of Engineers that this
body of water is not "waters of the United States," and therefore not under their
regulatory control. This letter is more than a year old, and it indicates that this
determination is subject to any changes in policy or regulations concerning these
matters. Please provide documentation from the USACE, or the Environmental
Scientist that prepared the request for determination, that no changes have taken place
that would impact this determination.
2. Please provide a plan for city review and comment on your proposed method of
draining the water fi.om the stock tank.
Please provide a plan for city review and comment on your proposed method of
protecting and relocating the existing wildlife. I would suggest contacting the Texas
Parks and Wildlife department for assistance in preparation of that plan.
Please provide the requested information prior to commencing any activity related to
draining or filling the existing tank. If you have any questions for me, please feel free to
contact me at your convenience.
