Dear Mr. Marvin:
I received a copy of a letter you wrote to Mr. Jun Jacobson dated March 10, 2005 related to breaching an
existing stock tank and rerouting the drainage through the site. You listed three concerns the City of Coppell
has related to the project. Concern Number l: requested a letter, from the USACE or the Environmental
Scientist that made the jurisdictional determination, be prepared indicating whether or not there had been any
changes to USACE policy or regulations that would change their (USACE's) determination as stated in their
February 24, 2004 letter.
The jurisdictional delineation was performed by Mr. Jason Morovitz who was working under my supervision.
Mr. Morovitz is no longer with Halff associates, but I am knowledgeable about the proposed project and the
USACE regulations and policy.
The subject stock pond and drainage were determined to be non-jurisdictional because they are not connected to
the natural tributary system of Denton Creek; therefore they are classified as isolated waters. The USACE
agreed with our determination as stated in their February 2004 letter. The USACE's regulations and policies
have not changed related to isolated waters and they would still be considered as non-jurisdictional waters.
