Thank you for your letter of January 8. 2004, concerning a proposal by Myers and Crox~
Company to construct an approximately 605,000 square foot commercial warehouse facility on
an approximately 31.5-acre tract of land. located immediately northeast of the intersection of
Sandy Lake Road and Royal Lane in CoppelL Dallas County, Texas. This project has been
assigned Project Number 200400010. Please include this number in all future correspondence
concerning this project, Failure to reference the project number may result in a delay.
Wc ha,,e reviewed ti'tis project in accordance with Section 404 of the ('lean Water Act and
Section 10 of the Rivers and Harbors Act of 1899. Under Section 404. tile U.S. Army Corps
Engineers (USACE) rcgulatcs tile discharge of dredged and fill material into waters of file [ nitcd
States. including wetlands. The USACE responsibility under Section l0 is to regulate any work
in. or afl'ccting, navigable waters of thc Unitcd States. Based on your description of thc proposed
wnrk, nther information available to us, and current regulations and policy, we have determined
that this project will not involve any of the above activities. ThereIbre. it will not require
Department of the Army authorization under the above laws. Howexcr. it is incumbent upon you
to remain intbnned of any changcs in USACE Regulatory Program regulations and policy as they
relate to your project.
