Dear Mr. Hinckley:
Work activity believed to be the fill of spoil dirt is again taking place on the above referenced tract. We have
made you aware in the past of the ordinances related to development activity in the City of Coppell (see letter
from October 25, 2004, attached). The ordinances and approval processes for work of this type have not
changed. We respectfully request again that you immediately cease all work activity on the tract until such
time as you have fulfilled the requirements of the ordinances referenced below:
Floodplain Ordinance 94-639, Article 5, Section B-6-a. - Encroachments are prohibited within
designated floodways, including fill, new construction, substantial improvements and other development
unless certification by a registered professional engineer is provided, demonstrating that equal conveyance
encroachments do not result in any increase in flood levels at any floodplain location and that all other
provisions of this ordinance are met during the occurrence of the base flood discharges.
Erosion and Sedimentation Control Code - Ordinance No. 91514 was designed to minimize erosion
and sedimentation from private property onto public rights-of-way, making it unlawful to permit a public
erosion nuisance and providing for a penalty of fine not to exceed the sum of $500 per day during which a
violation occurs.
Failure to follow the referenced ordinances could result in civil penalties for each day that the current situation
is allowed to continue.

referenced tract. We would like to make you aware of the adopted ordinances related to approved
development activity in the City of Coppell.
