Kimley-Horn and Associates has received a copy of the letter with attachments
sent to you by Dallas Water Utilities. We agree with DWU that Coppell
included design of relocation in design contract. However, that requirement
has been fulfilled. The design fee requested by DWU is for the redesign
required because of DWU's request to relocate the entire length of line in lieu
of only relocating the sections affected by the road design as previously
approved by DWU.
Upon reviewing the notes submitted by DWU, I have noted several possible
key points:
DWU normally takes care of design and construction ahead of paving
(1/6/94 Memo, Page 3).
Since design was already included in the Coppell contract, then
Coppell would pay for design and DWU pays for construction (1/6/94
Memo, Page 3).
Who actually does design depends upon Pipeline Design Department
review (1/6/94 Memo, Page 3, To Be Resolved, Note 3).
· Only about 15 % of DWU 30" water line within project is affected,
1,525 LF. (1/6/94 Memo, Page 1).
· DWU accepted relocation of 5,370 LF in 6 sections on July 21, 1994
(Project Chronology).
DWU directed 5,370 LF of relocation in 6 sections be designed with
an offset to allow 30" to remain in service during construction on May
17, 1996 (Project Chronology).

DWU directs Coppell to relocate entire length of 30" WL, 10,157 LF,
as a result of customer city comments made at joint workshop.
Conflicts noted occurred within 6 sections, 5,370 LF of relocation
already designed. December 19, 1996 (Project Chronology).
Kimley-Horn and Associates proceeded to complete the design changes
directed by DWIJ without the comfort of a contract amendment. The redesign
was complicated by the impact that the additional 4,787 LF of line relocation
had on the already completed designs of storm sewer and other utility
relocations.
Ken, please let me know if we can do anything to help or provide additional
information to help in your deliberations with Dallas. We are convinced that
the design fee and the construction cost together will be less than the $2.6
million budgeted for construction. DWU need only to commit to funding the
construction in total, regardless of total amount and to include any or all of
the engineering fees to the extent the construction cost is less than $2.6
million.
