FTTP-CS050601§ 1001.061. TELEPHONE COMPANIES. (a) An operating telephone company, an affiliate of the company, or an employee of the company ~ is exempt from this chapter with respect to any plan, design, specification, or service that relates strictly to the science and art of telephony. (b) This exemption includes the use of a job title or personnel classification by a person included under Subsection (a) if the person d~s not use: (1) the title or classification in connection with an offer to the public to perform engineering services; and (2) a name, title, or word that tends to convey the impression that a person not licensed under this chapter is offering to the public to perform engineering services. If you have the bonding language that is inClUded in the agreement with the contractor t would reference the agreement 1 suggest the letter read as follows. "The following is in response to your request regarding Professional Engineering Stamps and the posting of bonds by Verizon's contractors. In accordance with Section 1001:61 of the Texas Occupational Code, Telephone companies are exempt from any requirements for Professional Engineering Stamps. Therefore, it is the telecommunications industW standard to not provide Professional Engineering stamped drawings when submitting plans for city review. It is the contractors responsibility per the construction agreement with Verizon to provide the city with the necessary bonds in satisfaction of the cities reasonable bonding requirements for physical damages caused,to the city's infrastructure. Accordingly, the contractor shall comply with such reasonable requirements. Verizon appreciates the city issuing the necessa~ construction permits in a timely manner.
