Drainage Easement
Dear Mr. & Ms. Skinner:
As you are aware, the city intends to reconstruct Bethel Road. The first phase of improvements,
Bethel Road I, will extend from the west city limits to just east of Freeport Parkway. The second
phase of improvements, Bethel Road II, will extend from east of Freeport Parkway to Denton Tap
Road. The city wants to bid the Bethel Road I project in the 4th quarter of 2005 and the Bethel
Road II project in the 4th quarter of 2006.
As part of the Bethel I project, the consulting engineer prepared a study for the drainage basin (676
acres) above Coppell Road and designed the necessary storm water improvements. The existing
stream that starts at Freeport Parkway and extends through your property will be modified. It will
be replaced by a 35-foot bottom width, 6-foot deep, gabion basket side slope channel from Freeport
Parkway to east of Coppell Road. The stream north of Bethel Road is under the jurisdiction of the
U.S. Army Corps of Engineers (USACE). The city has worked with the USACE for over two years
to obtain a permit to construct the channel. The first application to the USACE was for an
Individual Permit to construct channel improvements from Freeport Parkway to east of Coppell
Road. Subsequent to the submittal and at the request of the city, the USACE removed the section
of stream from Freeport Parkway to north of Bethel Road from their jurisdiction. This aPowed the
city to reduce the scope of the permit and apply for a Nationwide Permit (NWP) which is less
restrictive than an Individual Permit. The city then submitted the second application for a NWP to
construct channel improvements from Bethel Road to approximately 350 feet northward. The
permit was finally approved by the USACE in May 2005.
The channel improvements from Bethel Road to 350 feet northward will be constructed with the
Bethel Road I project. The city will have to obtain a permit for the remaining portion of the
channel and it will be constructed with the Bethel Road II project.
The city will need a drainage easement from your property located
at 604 Loch Lane in order to construct the channel improvements.
In accordance with the NWP, the city is required to mitigate the t;oP~__ttL
impacts of the proposed channel modifications and enhance the

functions of the modified channel so that aquatic resources downstream are protected from
degradation. The bottom of the modified channel will be planted with native grasses, legumes and
wildflowers and the banks will be planted with native trees, shrubs, and native herbaceous species.
The easement will have to be deed restricted so that the mitigation area will not be disturbed,
except by those activities that would not adversely affect the intended extent, condition and
function of the mitigation area.
Enclosed is a copy of the easement required for the construction of the improved channel. The city
wants to advertise the Bethel Road I project in September 2005 and would like to meet with you to
discuss the easement. The City Engineer is out of the office until the first week in July and I will
contact you after that time to set up a meeting time.
