Let me know when you want to set up the next phase of our sidewalk project. Question Asked on Monday, August 18: The scope of work is to replace inset pavers on existing curb ramps. The work is necessary because the pavers are cracked and the joint material is loose and flaking. These existing curb ramps are similar in design to the illustration in Technical Memorandum 9902. However, some are noncompliant to TAS slope requirements. Question: Does the simple replacement of the inset pavers constitute a renovation; therefore requiring they be brought into full compliance with TAS 4.7, or may it be considered solely maintenance? Per TAS 4.1.6(1)(a) and (b), no alteration shall be undertaken which decreases or has the effect of decreasing accessibility of a facility below the requirements of ne~v construction and if existing elements are altered, each altered elements shall comply with the applicable provisions of 4.1.1 to 4.1.3. Clarification received from Gary Oliveras on August 22, 2003: Jim, just to expand a little more on our response, this would be the same as if an owner was replacing grab bars in a toilet room. Would you view this scope of work as an alteration? So, bottom line would be that the whole curb ramp would not have to be altered but the pavers xvould have to comply. Same as the toile rooms would not have to be altered but the grab bars would have to comply. 8/28/2003
