Per our instructions and in response to your letters, Darwish Otrok, Pmjeet Manager for Westchestcr Homes was sent to your home to make an evaluation and determination on the fireplace and the back yard. The first meeting with HarBt/ones with Overhead Door was arranged to address the problem with the fireplace. At this time. it was determined that the manoracmrer (Heat & Glo) needed to inspect the fireplace and make recommendations as to a solution. A mpreremative from Heat & Glo has since visited your home, on March 27, 1995. We are curremly awaiting a letter from Heat and Glo to slate exactly what they are going to do. Westchester is committed to repairing the fireplace so that it does not smoke. We sent a letter dated April 1st to you addressing our position on the situation regarding your back yard. (Copy enclosed). Friday, April 7, 1995 at 4:00 P.M. Mr. Otrok again inslaccmd the hackyard of your home as well as tim interior as he was direeted by Mrs. Melissa Smith. There are no signs of foundation or any other swactural failure. The only dr~l crack found, above the master bedroom balcony door, was a hairline crack so narrow that it could not be measured accurately by our standard measuring device (much less than the I/8' width which is warrantable). The door that Mrs. Melissa Smith showed Mr. Otmk, me upstairs master bedroom balcony door, was functioning properly. In summa~, again no evidence related to any problems with your foundation was discovered. The picture you sent is of fill dirt that you have added. Enclosed is a picture of an area along Texas highv,-ay 121 with a similar situation. Both have thc same problem. Whenever the soil I~camc sattuated the problem occurred, because the fill dirt was not of the proper type to compact adequately and secondly, because there was not a retaining wa'l to prevent the dirt from sliding, ffyou bad built a retaining wall and compacted the proper type fill behind it, this problem would not have occurred.
