Thank you for returning my call on Monday, as we discussed, we are in receipt ora
letter and copies of correspondence addressed to Ms. Malinda Vail and yourself.
Additionally, there are letters to Ms. Bridget Booth of Home Buyers Warranty, Mr.
Kenneth M. Griffith of the City of Coppell and Mr. Edward O'Toole of Gnmd
Homes. This package is from Mr. Stev~n W. Smith the home buyer ora Westchester
Florae at 977 Parker Drive. He has not included copies of any correspondence from
Westchester Homes.
The story which is expressed in the copies of correspondence and his original letter to
me tells o£problems associated with the lot and the home. He has done a thorough
job in chronicling his situation. Flowever, he has not included copies of any
correspondence which may have been provided in response to his inquiries.
As a Registered Professional Builder, you are under obligation to provide Mr. Smith
with a response to the issues which he sights. If you have failed to respond or choose
to not respond at this time, the FIAB Board of Directors will be required to appoint an
investigative committee. In our conversation on Monday, it sounds as if your firm
has attempted to solve many ofthe problems outlined in the the correspondence 1
look forward to reviewing that information.
I am enclosing, for your review, an article which outlines the Residential Constraction
Liability Act and the protections which are contained in the law. I hope that this
