Dear Mr. Moore,
Regarding the smoking fireplace that you installed in my home, please refer to the attached
letter to Mr. Atkins, Sales Representative of Heat-N-Glo.
Regarding your attached letter to me dated April 1, 1994; I did not receive that letter until
you enclosed it with the above referenced correspondence to me l~om Mr. But*ord.
Regarding your VP of Constructions response to the slope failure behind my home:
* The 'flu dirt that you have added' I can only assume that he i~ referring to the soil I
~ to the backyard, wheel barrd by wheel barrel full, in order to partially replace
the soil I lost when the subject bank collapsed the fu'st time in Suiy of 1994. I also
bought a pallet of sod to again resurface that which I had lost.
* In the fail of 1994, the subject bank again began to fall. Since the beginning of this
reoccurrence of the slope failure, I have not added any more ~ dirt to my backyard.
On December 10, 1994, Ken Grif~n, the Asst. City Manager/Dh-. of Public Works,
notified all residents with homes that back a?inst Denton Creek, that no one can place
~ in their backyards that will end up in Denton Creek. A copy of this letter can be
provided upon request.
* If Mr. Buford honestly believes that my placing fill dirt is causing the collapse of the
subject slope, please have him explain to me the following:
1) Why did the slope fail the ~ time prior to me hand lifl~g the ~li dirt*?
2) Why is there similar slope failure in the backyards of my contiguous neighbors,
Leslie Mathis wl~ 214-518-6823, who owns a home built by Westchester and
complete ~ 11/93; and Russ Olivier wk~ 817-967-2653 who owns a home built
by Grand and completed (~ 6/93?
* ff any parties involved in this matter would like picture of the slope failure behind
these homes, I will be glad to provide it.
* The urgency, however, lies with my home since the foundation of my house is
positioned closer to the subject slope failure than my neighbors.

Regarding the over 20 other items that need to be repaired in this house, which I brought
to your attention in my letters to Ms. Vail dated March 13 and March 31, 1995; when
speaking with Ms. Vail 3/20/95, she said t~t she just completed the work order and Jim
would be calling. I am still waiting for Jim s phone call and hope to have the repairs made
to the house in the near future.
